【摘要】:永嘉學(xué)派,又稱“事功學(xué)派”、“功利學(xué)派”等,是南宋時期在浙東永嘉(今溫州)地區(qū)形成的、提倡事功之學(xué)的一個儒家學(xué)派,是南宋浙東學(xué)派中的一個重要分支。因其代表人物多為浙江永嘉人而得名。永嘉學(xué)派繼承并發(fā)展了傳統(tǒng)儒學(xué)中“外王”和“經(jīng)世”的一面,使儒家的學(xué)說不至于完全陷入純講求個人的心性修養(yǎng),從而使它成為南宋儒學(xué)的一個重要側(cè)面。 社會主義法治現(xiàn)代化的建設(shè),不僅要學(xué)習(xí)西方先進的法治理念,,為我所用,更應(yīng)該反觀傳統(tǒng),從傳統(tǒng)中尋找根基。葉適(1150-1223)作為南宋哲學(xué)家、文學(xué)家,永嘉學(xué)派集大成者,在哲學(xué)、史學(xué)、文學(xué)以及政論等方面都有貢獻。因此,現(xiàn)階段,對于葉適的法律思想進行探索,具有重大的現(xiàn)實意義。本文將通過四章內(nèi)容來論述葉適的思想,分別是第一章,葉適與永嘉學(xué)派,主要講述葉適生平、永嘉學(xué)派的發(fā)展歷程及葉適在永嘉學(xué)派中的重要地位;第二章,葉適的義利觀。之所以論述葉適的義利觀,主要是因為葉適的法律思想表現(xiàn)出對其倫理思想的強烈依附性,其中葉適的義利觀是對葉適事功主義法律思想產(chǎn)生具有決定作用的倫理思想,所以第二章將重點論述葉適的義利觀。本章中,將對儒法兩家傳統(tǒng)義利觀進行梳理,探尋“義”“利”本源,在此基礎(chǔ)上,對葉適的義利觀進行梳理總結(jié)和論述;第三章,葉適的事功法律思想。本章將對葉適具體的法律思想進行論述,主要是葉適變法的思想和主張、立法為公的思想、以民為本的思想、法律執(zhí)行中重視人的作用等方面;第四章,葉適法律思想的時代意義。本章主要講述葉適的法律思想對南宋王朝的影響及對當(dāng)代社會主義建設(shè)的啟示。
[Abstract]:Yongjia School, also known as "Shi Gong School" and "utilitarian School", was formed in Yongjia (present Wenzhou) area of eastern Zhejiang during the Southern Song Dynasty. Because its representative personage is Zhejiang Yongjia people and get the name. The Yongjia School inherited and developed the side of "external king" and "managing the world" in the traditional Confucianism, so that the Confucian doctrine did not completely fall into the pure individual mind cultivation, thus making it an important aspect of Confucianism in the Southern Song Dynasty. In the construction of socialist legal modernization, we should not only learn the advanced western idea of rule of law, but also look back at the tradition and seek the foundation from the tradition. As a philosopher, writer and generalist of Yongjia School in the Southern Song Dynasty, he made contributions to philosophy, historiography, literature and political theory. Therefore, it is of great practical significance to explore Ye Shi's legal thought at the present stage. This text will discuss Ye Shi's thought through four chapters, namely the first chapter, Ye Shi and Yongjia school, mainly narrate Ye Shi's life, the development course of Yongjia school and the important position of Ye Shi in Yongjia school; the second chapter, Ye Shi's view of righteousness and profit. The main reason for discussing Ye Shi's view of righteousness and profit is that Ye Shi's legal thought shows a strong dependence on his ethical thought, among which Ye Shi's view of righteousness and profit is an ethical thought that has a decisive effect on the generation of Ye Shi's doctrine of law. So the second chapter will focus on Ye Shi's view of righteousness and profit. In this chapter, the author combs two traditional views on righteousness and profit of Confucianism and law, and explores the origin of "righteousness" and "interest", on the basis of which, summarizes and discusses Ye Shi's view of righteousness and profit. This chapter will discuss Ye Shi's specific legal thought, mainly the thought and proposition of Ye Shi's reform, the thought of legislating for the public, the thought of taking the people as the basis, and the emphasis on the role of people in the enforcement of the law. The epoch significance of Ye Shi's legal thought. This chapter mainly tells the influence of Ye Shi's legal thought on the Southern Song Dynasty and its enlightenment to the contemporary socialist construction.
