【摘要】： 法律與發(fā)展運(yùn)動(dòng)是一場(chǎng)發(fā)端于20世紀(jì)50年代由美國(guó)引領(lǐng)的浩大理論與實(shí)踐活動(dòng),其在經(jīng)歷了70年代的失敗之后并沒(méi)有因此而銷(xiāo)聲匿跡,而是在90年代出現(xiàn)復(fù)興的跡象,至今仍有很多學(xué)者在進(jìn)行更深入的研究和探索,有學(xué)者稱(chēng)之為“新法律與發(fā)展運(yùn)動(dòng)”或“法律與發(fā)展運(yùn)動(dòng)的新發(fā)展”。1然而在中國(guó),無(wú)論是政府還是法學(xué)界對(duì)法律與發(fā)展運(yùn)動(dòng)的研究和關(guān)注可以說(shuō)都是非常少的,中國(guó)改革開(kāi)放以來(lái)在法律制度相對(duì)薄弱的情況下取得了長(zhǎng)足的發(fā)展,這也使得有些人開(kāi)始懷疑法律與發(fā)展理論的正確性及對(duì)中國(guó)的價(jià)值。本文旨在在梳理法律與發(fā)展理論與實(shí)踐的基礎(chǔ)上,著重分析其對(duì)中國(guó)的啟示意義。 文章從四個(gè)部分展開(kāi),第一部分首先介紹舊法律與發(fā)展運(yùn)動(dòng)的發(fā)展過(guò)程、理論基礎(chǔ),以及對(duì)法律與發(fā)展運(yùn)動(dòng)的反思,其中重點(diǎn)分析了舊法律與發(fā)展運(yùn)動(dòng)失敗的原因。第二部分介紹了新法律與發(fā)展運(yùn)動(dòng)興起的背景及理論基礎(chǔ)及其面臨的挑戰(zhàn)。第三部分則分析了新形勢(shì)下法律與發(fā)展運(yùn)動(dòng)的理論轉(zhuǎn)向。文章第四部分重點(diǎn)介紹了中國(guó)的發(fā)展與發(fā)展的問(wèn)題,包括法律與發(fā)展理論在中國(guó)的研究現(xiàn)狀、被忽視的原因等,著重分析了法律與發(fā)展理論與實(shí)踐對(duì)中國(guó)發(fā)展的啟示。
[Abstract]:The law and development movement is a great theoretical and practical activity led by the United States in the 1950 ' s . After the failure of the 1970s , there are still a lot of scholars who have made more in - depth research and exploration . But in China , both the government and the law circle have made more in - depth research and exploration , some scholars call it " the new law and development movement " or " the new development of law and development . " However , in China , both the government and the law circle have made great progress in the relatively weak legal system . This paper aims at analyzing the significance of its enlightenment to China on the basis of combing the theory and practice of law and development .



This article begins with four parts , the first part introduces the development process , the theoretical foundation and the reflection of the law and development movement . The second part introduces the background and the theoretical foundation of the new law and development movement . The third part introduces the development and development of the new law and the development movement . The fourth part focuses on the development and development of China , including the current situation of the research in China , the reasons for being ignored , and the inspiration of the theory and practice of law and development to China ' s development .
