【摘要】：當(dāng)代中國正在進(jìn)入風(fēng)險(xiǎn)社會(huì),主要表現(xiàn)在貧富差距已達(dá)警戒水平,公共安全狀況惡化,應(yīng)對(duì)群體事件不力產(chǎn)生政治風(fēng)險(xiǎn)等。為了應(yīng)對(duì)風(fēng)險(xiǎn)社會(huì),法律應(yīng)作出適當(dāng)?shù)淖兏?法律中的傳統(tǒng)責(zé)任理論也應(yīng)適度讓步于風(fēng)險(xiǎn)社會(huì),要有適度超前的法律變革理念,要掌握好社會(huì)發(fā)展和風(fēng)險(xiǎn)增加之間的平衡,制定和諧統(tǒng)一的法律制度。
[Abstract]:Contemporary China is entering a risk society, mainly manifested in the gap between the rich and the poor has reached a warning level, the situation of public security has deteriorated, and the failure to deal with group incidents has produced political risks. In order to deal with the risk society, the law should make appropriate changes, the traditional liability theory in the law should also give way to the risk society, there should be a moderately advanced idea of legal reform, and the balance between social development and risk increase should be well grasped. Formulate a harmonious and unified legal system.
