人本法律觀視域下的基礎教育法治建設

【摘要】:科學發(fā)展觀的提出為中國的法治建設和法學研究提供了理論依據(jù)。人本法律觀是科學發(fā)展觀在法學領域的體現(xiàn)和應用,也是馬克思主義法學中國化的重要成果。我們既要深刻理解認識人本法律觀的理論價值,又要科學運用人本法律觀來指導社會主義法治建設。人本法律觀理論已經(jīng)在立法、執(zhí)法、司法等領域的法治實踐中有所運用,,但是在基礎教育法治建設中的應用還缺乏研究,本文宗旨就是從人本法律觀的視角提出加強基礎教育法治建設的對策。 文章主體內(nèi)容分為以下三個部分: 第一部分,從理論上闡述人本法律觀這個馬克思主義法學中國化的重要成果。擬從人本法律觀的提出及其科學內(nèi)涵、人本法律觀提出的理論價值及其對基礎教育法治建設的指導意義等內(nèi)容進行闡述,意在為本文奠定理論基礎。 第二部分,介紹我國基礎教育法治建設的現(xiàn)狀。現(xiàn)狀包括我國基礎教育法治建設取得的成就和存在的問題。本文對基礎教育法治建設的成就做了簡要的總結,主要筆墨用于闡述基礎教育法治建設面臨的問題,使研究有針對性,有的放矢。 第三部分,這是本文的重點部分,也是本文的價值所在,主旨是研究如何以人本法律觀為指導加強我國基礎教育法治建設。對此部分內(nèi)容,闡述如下:首先,要樹立以人為本的教育法治觀。其次,在人本法律觀指導下明確良法的制定標準,在立法過程中要求以人本法律觀為指導。再次,教育行政執(zhí)法法治建設的過程中需要由人本法律觀為指導,完善教育執(zhí)法體制。加強教育執(zhí)法監(jiān)督。另外,還要理順基礎教育法治建設中的師生法律關系,加強教師法律意識的培養(yǎng)。 總之,本文是以人本法律觀為視角,探討人本法律觀視域下的基礎教育法治建設,研究人本法律觀在我國基礎教育法治建設中的指導地位以及人本法律觀做為一種方法論對于基礎教育法治建設實踐的指導作用。
[Abstract]:The scientific concept of development provides a theoretical basis for the construction of the rule of law and the study of law in China. The humanistic legal view is the embodiment and application of the scientific development view in the field of law, and it is also an important achievement of the Sinicization of Marxist jurisprudence. We should not only deeply understand the theoretical value of the humanistic legal view, but also scientifically apply the humanistic legal concept to guide the construction of socialist rule of law. The theory of humanist legal view has been applied in the practice of the rule of law in the fields of legislation, law enforcement and judicature, but the application of the theory in the construction of the rule of law in basic education is still lack of research. The purpose of this paper is to put forward the countermeasures to strengthen the legal construction of basic education from the viewpoint of humanism. The main content of the article is divided into the following three parts: In the first part, the author expounds the important achievement of humanism law in China. It is intended to lay a theoretical foundation for this paper from the viewpoint of humanism and its scientific connotation, the theoretical value of humanism and its guiding significance to the construction of the rule of law in basic education. The second part introduces the current situation of the construction of basic education rule of law in our country. The present situation includes the achievements and problems in the construction of basic education rule of law. This paper makes a brief summary of the achievements in the construction of the rule of law in basic education. The main works are used to expound the problems facing the construction of the rule of law in basic education, so that the research can be targeted and targeted. The third part, this is the key part of this article, is also the value of this article, the purpose is to study how to strengthen the legal construction of basic education in our country under the guidance of humanism law. To this part, expound as follows: first, should establish the view of educational rule of law of people-oriented. Secondly, under the guidance of humanism law, we should make clear the standard of making good law, and should be guided by humanism in the legislative process. Thirdly, it is necessary to perfect the educational law enforcement system under the guidance of humanism law view in the process of educational administrative law enforcement. We will strengthen the supervision of educational law enforcement. In addition, it is necessary to straighten out the legal relationship between teachers and students in the construction of the rule of law in basic education and strengthen the cultivation of teachers' legal consciousness. In a word, this paper discusses the legal construction of basic education from the viewpoint of humanism law. This paper studies the guiding role of humanism in the construction of the rule of law in China's basic education and the guiding role of the humanistic legal view as a methodology for the practice of the construction of the rule of law in basic education.
