【摘要】：本文在對(duì)法律制度自身發(fā)展和其大眾化過程中兩對(duì)矛盾分析的基礎(chǔ)上,分別考察了在中國(guó)電視屏幕上流行的"電視法制社教節(jié)目"和"法制題材電視劇"兩種話語方式。通過比較分析它們?cè)跀⑹鲞^程中不同的訴求、手段和效果,電視社教法制節(jié)目通過相對(duì)封閉的敘述方式,將故事納入法律的解釋體系,可能彌合"應(yīng)然之法"與"實(shí)然之法"之間的矛盾;法制題材電視劇則將法律融入更為廣闊的社會(huì)語境,從而為現(xiàn)實(shí)生活與法律規(guī)則之間的矛盾共生提供一個(gè)相對(duì)開放的電視文本。
[Abstract]:Based on the analysis of two pairs of contradictions in the development of the legal system itself and its popularization, this paper examines the two discourse modes of "TV legal Social Education Program" and "legal subject TV Series", which are popular on Chinese television screens.Through the comparative analysis of their different demands, means and effects in the narrative process, TV social education and legal programs bring the story into the legal interpretation system through a relatively closed narrative method.It is possible to bridge the contradiction between the "law of what ought to be" and the "law of reality", while TV dramas on the subject of legal system will integrate the law into a broader social context,Thus provides a relatively open TV text for the contradiction between real life and legal rules.
