【摘要】： 《唐律疏議》是中國乃至世界法制史上的瑰寶。它在中國古代的法典中,無論體例結(jié)構(gòu),還是內(nèi)容,都被認為是中國古代立法中的最善者。清代法學(xué)哲人薛允升通過對唐明律的比較,認為在中國法典中,“唐律為最善”,明初丞相李善長曾說：“歷代之律,皆以漢《九章》為宗,至唐始集其成�！碧坡蓞R集唐以前立法之精華,集唐以前立法之大成。 《唐律疏議》在歷史上具有很大的影響,歷代學(xué)人皆予以關(guān)注。積累了很多研究成果。這部法典密切聯(lián)系唐代社會實際并且應(yīng)用于唐代社會實際,雖然距今已經(jīng)12個世紀,有很多法條仍然顯示了歷史的前瞻性,值得我們繼續(xù)研究；此外,《唐律疏議》也留下了反映社會歷史發(fā)展的豐富史料,值得從歷史學(xué)的角度進一步探討。 本課題立足于文獻學(xué)的角度,系統(tǒng)梳理《唐律疏議》的律條,選擇若干問題,探索其歷史學(xué)的意義和法學(xué)意義,旨在進一步挖掘《唐律疏議》法學(xué)、歷史學(xué)的學(xué)術(shù)內(nèi)涵,加深認識這部著名法典的文獻學(xué)價值。重點探索三個問題：《唐律疏議》保護生態(tài)環(huán)境的法條分析與認識；《唐律疏議》反映唐代社會歷史和古代法制的史料學(xué)價值；《唐律疏議》的文獻學(xué)地位。 近年來,在科學(xué)發(fā)展觀支配下,越來越重視生態(tài)環(huán)境方面的社會管理�！短坡墒枳h》已經(jīng)出現(xiàn)了若干關(guān)于保護生態(tài)環(huán)境的法條、足見中國歷史上關(guān)注生態(tài)環(huán)境的意識誕生之早,唐代能夠運用法律工具加以管理,這是值得重新認識的問題。探索這一問題的歷史原貌、考察其實施的社會實際,不僅僅有利于認識唐代關(guān)于生態(tài)環(huán)境管理的歷史水平,對于今天也具有借鑒意義。 本課題在前人研究的基礎(chǔ)上,立足于文獻學(xué)的角度,系統(tǒng)梳理《唐律疏議》的律條,選擇若干問題,進一步探索其法學(xué)、歷史學(xué)、文獻學(xué)意義。 法學(xué)方面,《唐律疏議》不僅保存了唐代法典,其中的“疏議”,涉獵了與“唐律”并行的“格”“式”“令”以及古代的很多法令,其法學(xué)各個層面的內(nèi)涵豐富,影響深遠�！端膸烊珪偰俊ぬ坡墒枳h提要》載：唐律“宋世多采用之。元時斷獄,亦每引為據(jù)。明洪武初,命儒臣同刑官進講唐律。后命劉維謙等詳定明律,其篇目一準予唐；至洪武二十二年刑部請編類頒行,始分吏、戶、禮、兵、刑、工六律,而以名例冠于篇首”。有利于進一步認識這部中國歷史上唯一傳世的成文法典的法學(xué)方面的歷史地位和學(xué)術(shù)價值。 歷史學(xué)方面,《唐律疏議》從法律的層面,反映了唐代運用法律制度、法律措施管理社會的歷史,留下了唐代社會發(fā)展的軌跡。系統(tǒng)梳理這部原典,可以獲得唐代社會歷史的很多信息另外,《唐律疏議》關(guān)于唐代社會歷史很多重大問題,都有其法律層面的體現(xiàn),無論立法的內(nèi)容或者法律思想方面,都關(guān)系到唐代社會歷史興衰,為深入研究唐代社會歷史提供豐富的史料。因而具有唐代史料學(xué)的意義。 文獻學(xué)方面,《唐律疏議》是唐代的成文法典,也是中國歷史上保存比較完好的成文法典,其結(jié)構(gòu)、體例、內(nèi)容,也從文獻學(xué)方面留下了寶貴的歷史文本。唐代社會生活中,頒行了一系列的令、格、式,散亂于各種文獻,有的惜已亡逸。只有律及律借助于《唐律疏議》保存下來。 綜上所述,本課題重點探索三個問題：《唐律疏議》保護生態(tài)環(huán)境法的分析與認識；《唐律疏議》保存唐代社會歷史和古代法制的史料學(xué)價值；《唐律疏議》的文獻學(xué)地位。
