【摘要】："人肉搜索"作為一種獨(dú)特的網(wǎng)絡(luò)現(xiàn)象,在發(fā)揮弘揚(yáng)社會(huì)道德、輿論監(jiān)督、協(xié)助偵破案件等正面功能的同時(shí),也時(shí)常伴隨著侵犯公民個(gè)人權(quán)利、損害政府公信力等負(fù)面影響的出現(xiàn)。刑法誹謗罪可以有效地規(guī)范"人肉搜索"行為,防止"人肉搜索"為網(wǎng)絡(luò)暴力所利用。文章由"人肉搜索"司法第一案引申思考,詳細(xì)分析了誹謗罪的法律構(gòu)成,并對(duì)"人肉搜索"中各主體的誹謗罪責(zé)任進(jìn)行了探討,提出了立法建議。
[Abstract]:"Human flesh search", as a unique network phenomenon, plays a positive role in promoting social morality, supervision by public opinion, assisting in the detection of cases, and so on, at the same time, it is often accompanied by infringement of the individual rights of citizens.Damage to the credibility of the government and other negative effects appear.Criminal libel can effectively regulate "human flesh search" and prevent "human flesh search" from being exploited by network violence.From the first judicial case of "Human flesh search", this paper analyzes the legal constitution of libel in detail, probes into the libel liability of each subject in "Human flesh search", and puts forward some legislative suggestions.
