【摘要】： 法治與村民自治的推廣正在進(jìn)行中,兩者無論是在理論層面,還是在實(shí)踐層面都存在諸多相同點(diǎn)和不同點(diǎn),這就決定了兩者之間既可能達(dá)到理想的契合狀態(tài),也可能產(chǎn)生緊張和矛盾。當(dāng)代中國適逢社會轉(zhuǎn)型期,如何避免兩者之間緊張和矛盾的產(chǎn)生或者把沖突所造成的消極影響降至最低限度,促進(jìn)兩者的完美契合,實(shí)現(xiàn)兩者的良性互動,對于中國的民主憲政建設(shè)、社會主義和諧社會建設(shè)和社會主義新農(nóng)村建設(shè)都具有十分重要意義。 社會主義新農(nóng)村建設(shè)是一項系統(tǒng)工程,依法治國方略和村民自治應(yīng)該完美地結(jié)合起來,互為支撐,依靠法治來保障村民自治,通過村民自治來真正地實(shí)現(xiàn)法治,以實(shí)現(xiàn)二者的良性互動,最終統(tǒng)一于我國的民主憲政建設(shè)。
[Abstract]:The promotion of the rule of law and villagers' autonomy is in progress. There are many similarities and differences in both theory and practice, which determines the ideal state of agreement between the two.Tension and conflict can also arise.Contemporary China coincides with a period of social transformation, how to avoid the tension and contradiction between the two or to minimize the negative impact caused by the conflict, promote the perfect fit between the two, and realize the benign interaction between the two.The construction of socialist harmonious society and new socialist countryside are of great significance to the construction of democratic constitutionalism in China.The construction of a new socialist countryside is a systematic project. The strategy of governing the country according to law and villagers' autonomy should be perfectly combined and supported each other, relying on the rule of law to guarantee villagers' autonomy, and truly realizing the rule of law through villagers' autonomy.In order to achieve the benign interaction between the two, the final unity in China's democratic constitutional construction.
