論先秦法家的價值體系

【摘要】:法家的政治理論,包括法、術(shù)、勢三大方面。商鞅重"法",申不害重"術(shù)",慎到重"勢",韓非作了批判總結(jié),提出了君、勢、法、術(shù)相結(jié)合的系統(tǒng)理論。勢,指君主的權(quán)勢、權(quán)力;法,指由君主統(tǒng)一公布施行的法律、法令;術(shù),指君主的統(tǒng)治術(shù)。三者雖有各自相對獨立的價值,但"皆帝王之具也",都是君主權(quán)力的表現(xiàn),也是維護(hù)君主權(quán)力的工具。在法家的價值體系中,"君主"是"神圣"的化身,"權(quán)勢"是"勝眾"的資本,"法制"是治世的法寶,"術(shù)數(shù)"是御臣的工具。君主處于最高的價值層次,居于主體地位,而作為"帝王之具"的勢、法、術(shù)則屬于較低的價值層次;蛘哒f,君主是"目的性"價值,勢、法、術(shù)是"工具性"價值。法家價值體系的邏輯結(jié)構(gòu)為:君←勢(權(quán))←法←術(shù)。
[Abstract]:The political theory of Legalists includes three aspects: law, technique and power.Shang Yang weighs "law", pays no harm to "skill", and takes care of "power". Han Fei has made a critical summary and put forward a systematic theory of combining monarch, potential, law and art.Power refers to the power and power of a monarch; law is a law or decree promulgated uniformly by a monarch; a monarchy.Although each of them has its own relative independent value, it is the expression of monarch's power and the tool of defending monarch's power.In the value system of Legalists, "monarch" is the embodiment of "sacred", "power" is the capital of "victory over the masses", "legal system" is the magic weapon of governing the world, "skill count" is the tool of imperial ministers.The monarch is in the highest value level and is in the main position, but as the power of the emperor, the law and the art belong to the lower value level.In other words, the monarch is the value of purpose, power, law and skill.The logical structure of the value system of Legalists is: the power of the monarch (power).
