【摘要】： 監(jiān)獄在我國源遠(yuǎn)流長,監(jiān)獄制度也隨著國家的產(chǎn)生在漫漫歷史長河中一步步發(fā)展起來。到了宋朝,在繼承唐制的基礎(chǔ)上又有所發(fā)展,有了很多新特點(diǎn)。 中國古代監(jiān)獄類型分為拘禁監(jiān)、勞役監(jiān)。拘禁監(jiān),以肉刑和死刑為主要刑罰體系；勞役監(jiān)“晝則役作,夜則拘之”。幾千年監(jiān)獄刑罰制度中,從原始的酷刑而逐漸演變。奴隸制的五刑墨、劓、刖、宮、大辟,是以“斷肢體、刻肌膚”為主要特征的肉刑體系,這種以恥辱刑為主的體系,決定了以拘禁、勞役為功能的監(jiān)獄在當(dāng)時不可能太發(fā)達(dá),與此相應(yīng)的監(jiān)獄制度也是如此。 隋朝確立的笞、杖、徒、流、死這封建制五刑,具有劃時代進(jìn)步意義的一點(diǎn)在于設(shè)立了徒、流刑。唐朝繼承了這五刑,并有了加役流刑,罪犯也需要服勞役,可是唐朝的監(jiān)獄仍然是以拘禁監(jiān)為主。 宋代由于時代背景特殊,配刑得到廣泛適用,相應(yīng)的,勞役監(jiān)也得到長足發(fā)展,越來越發(fā)達(dá),并漸漸形成了一套完備的勞役監(jiān)體系,如執(zhí)行地點(diǎn)牢城,也形成了內(nèi)地牢城、遠(yuǎn)惡州軍牢城、海島牢城這套三級階的體制。因此,宋代監(jiān)獄制度呈現(xiàn)勞役監(jiān)發(fā)達(dá)的典型特點(diǎn)。 同時,宋代的囚犯禁系管理制度、獄官責(zé)任制度也得到了一定程度的發(fā)展,前者有了更人性化細(xì)化的規(guī)定,后者也被規(guī)定得非常詳細(xì)全面。 本文充分運(yùn)用文獻(xiàn)綜合、實(shí)證分析方法,在搜集、分析和研究大量正史資料的基礎(chǔ)上,勾勒宋代監(jiān)獄制度的概貌,概括其特點(diǎn)。本文還注意運(yùn)用對比研究的方法,將宋代監(jiān)獄制度與唐代相關(guān)監(jiān)獄制度作比較,以求更準(zhǔn)確地解讀和歸納宋代監(jiān)獄制度的特點(diǎn)。 本文分三個部分。第一部分簡述宋代的監(jiān)獄制度立法。第二部分詳述宋代監(jiān)獄制度的具體內(nèi)容,從監(jiān)獄設(shè)置和監(jiān)獄管理制度的發(fā)展變化兩個方面展開論述。第三部分總結(jié)宋代監(jiān)獄制度的典型特點(diǎn),其特點(diǎn)包括監(jiān)獄設(shè)置規(guī)模完整龐大、監(jiān)獄管理制度更加成熟、勞役監(jiān)發(fā)達(dá)。結(jié)語部分對宋代監(jiān)獄制度的實(shí)際執(zhí)行和歷史借鑒意義作了一定闡述。
[Abstract]:Prison has a long history in China, and the prison system has developed step by step with the emergence of the country.In the Song Dynasty, on the basis of inheriting the Tang system, it developed and had many new features.The types of ancient Chinese prisons were divided into detention prison and labor prison.The main penalty system is corporal punishment and death penalty.Thousands of years of prison penalty system, from the primitive torture and gradually evolved.The five punishments of slavery, such as Mo, Li, Si, Gong, Da-Pi, are a system of corporal punishment characterized by "broken limbs and engraved skin". This system, which is dominated by humiliating punishment, determined that prisons with the functions of detention and servitude could not have been developed too well at that time.The same applies to the corresponding prison system.The sui Dynasty established the five punishments of caning, staff, apprenticeship, liu, and death, which has epoch-making progressive significance is the establishment of apostles, flow of punishment.The Tang Dynasty inherited the five sentences and had the penalty of increased servitude, and the criminals were also required to serve hard labor, but the prison of the Tang Dynasty was still dominated by detention.Due to the special background of the times, the allocation of punishment was widely applied in the Song Dynasty. Accordingly, the prison of servitude developed rapidly and developed more and more, and gradually formed a complete system of labor supervision, such as the execution location of the prison city, but also the formation of a prison city in the interior.Far evil state military prison city, island prison city this set of three-stage system.Therefore, the Song Dynasty prison system presents the typical characteristics of the developed labor prison.At the same time, the management system of inmate prohibition in Song Dynasty and the responsibility system of prison officials have been developed to a certain extent. The former has more humanized and detailed regulations, and the latter has been stipulated in a very detailed and comprehensive way.On the basis of collecting, analyzing and studying a large number of official historical data, this paper outlines the general outline of the prison system in Song Dynasty and summarizes its characteristics.This paper also pays attention to the comparison between the prison system of Song Dynasty and the relevant prison system of Tang Dynasty by using the method of comparative study in order to interpret and sum up the characteristics of prison system of Song Dynasty more accurately.This paper is divided into three parts.The first part briefly describes the Song Dynasty prison system legislation.The second part details the specific contents of the Song Dynasty prison system, from the prison establishment and prison management system development and change two aspects.The third part summarizes the typical characteristics of the prison system in Song Dynasty, including the large scale of prison establishment, the more mature prison management system and the developed labor prison.The conclusion part expounds the practical implementation and historical significance of the prison system in Song Dynasty.
