【摘要】：皋陶法律思想有如下幾個(gè)基本特點(diǎn):其一是強(qiáng)調(diào)德法結(jié)合,其二是強(qiáng)調(diào)以民為本,其三是強(qiáng)調(diào)司法公正與審慎司法,其四是強(qiáng)調(diào)天人合一。其思想輪廓包括了修身、明德、敬天、慎罰和安民等要素,為后來的儒家思想體系提供了基本的思想元素。皋陶的思想遺產(chǎn)不僅為先秦儒家所繼承,儒家的德法結(jié)合理論、天人合一思想、民本思想及司法公正、司法審慎等都能在《尚書·皋陶謨》中找到相對應(yīng)的思想,這說明儒家思想與《皋陶謨》的思想存在著強(qiáng)烈的關(guān)聯(lián)性。《皋陶謨》所包含的思想資源可為當(dāng)下的制度建設(shè)提供借鑒和參考。
[Abstract]:Gaotao's legal thought has the following basic characteristics: one is to emphasize the combination of Germany and law, the other is to emphasize people-oriented, the third is to emphasize judicial justice and prudent justice, and the fourth is to emphasize the unity of nature and man.The outline of its thought includes the elements of self-cultivation, Ming virtue, deference to heaven, careful punishment and peace of the people, which provided the basic ideological elements for the later Confucian thought system.Gaotao's ideological heritage is not only inherited by the pre-Qin Confucianists, but also the Confucian theory of the combination of morality and law, the idea of the unity of nature and man, the thought of people-oriented and judicial justice, judicial prudence, and so on can find corresponding thoughts in Shangshu Gaotao.This shows that there is a strong correlation between the Confucian thought and the thought of "Gaotaomu", and the ideological resources contained in the "Gaotaomu" can provide reference and reference for the present system construction.
