藏傳佛教與犯罪控制研究

【摘要】: 犯罪作為一種最嚴(yán)重的社會(huì)越軌行為,是影響人類社會(huì)穩(wěn)定的重大破壞因素,因此必須進(jìn)行犯罪控制,以維護(hù)社會(huì)穩(wěn)定。要有效控制犯罪,就應(yīng)該利用各個(gè)方面的有利因素。藏傳佛教作為勸善戒惡的宗教,對于犯罪的控制有著積極的意義。本文探究了藏傳佛教對犯罪控制的作用,以期豐富犯罪控制理論,為犯罪控制提供一個(gè)新的視角,使我國的犯罪控制實(shí)踐更富成效。 本文共分為四章。 第一章從概況、發(fā)展歷史、宗教儀式三個(gè)方面對藏傳佛教作了簡要介紹。藏傳佛教是指發(fā)端于青藏高原,主要流傳于我國藏族地區(qū)的佛教,其在西藏的發(fā)展經(jīng)歷了“前弘期”和“后弘期”兩個(gè)歷史階段,紛繁復(fù)雜的宗教儀軌構(gòu)成了藏傳佛教的重要特色。 第二章介紹了藏傳佛教的倫理準(zhǔn)則和道德規(guī)范。藏傳佛教的倫理準(zhǔn)則主要有去惡從善、平等慈悲、自利利他等,包括了一個(gè)人從惡中回頭、提高自身修養(yǎng)進(jìn)而幫助他人的整個(gè)過程。藏傳佛教的道德規(guī)范包括五戒、十善、四攝和六度等,它們構(gòu)成了完整的藏傳佛教道德規(guī)范體系。藏傳佛教的倫理準(zhǔn)則和道德規(guī)范對凈化人心,提高人的道德素質(zhì),增強(qiáng)人們的自律意識(shí),協(xié)調(diào)人際關(guān)系,消除矛盾糾紛,穩(wěn)定社會(huì)秩序具有積極的作用。 第三章闡述了犯罪控制的含義并對宗教對犯罪控制的可行性進(jìn)行了分析。犯罪控制就是遏制犯罪的發(fā)展,使之不超出一定范圍,將犯罪限制在正常度以內(nèi)。按照不同的控制階段,犯罪控制可以劃分為犯罪預(yù)防(狹義)、犯罪控制(狹義)、犯罪懲處和犯罪矯正四個(gè)方面。宗教在事前控制、事中控制、事后控制三個(gè)方面都能發(fā)揮控制犯罪的作用。 第四章分析了藏傳佛教對西藏犯罪控制的作用。首先介紹了歷史上藏傳佛教對西藏犯罪控制的作用,然后從社會(huì)控制功能、道德教化功能、心理調(diào)適功能、社會(huì)整合功能四方面闡述了當(dāng)代社會(huì)藏傳佛教對西藏犯罪控制的作用,最后提出利用藏傳佛教進(jìn)行犯罪控制應(yīng)堅(jiān)持辯證分析原則和藏傳佛教與其他犯罪控制手段綜合治理的原則。
[Abstract]:As one of the most serious social deviant behaviors, crime is a major destructive factor affecting the stability of human society. Therefore, crime control must be carried out in order to maintain social stability.In order to control crime effectively, we should take advantage of various factors.Tibetan Buddhism, as a religion that exhorts good from evil, has positive significance for the control of crime.This paper explores the role of Tibetan Buddhism in crime control, with a view to enriching the theory of crime control, providing a new perspective for crime control, and making our country's crime control practice more effective.This paper is divided into four chapters.The first chapter briefly introduces Tibetan Buddhism from three aspects: general situation, history of development and religious ceremony.Tibetan Buddhism refers to Buddhism that originated in the Tibetan Plateau and spread mainly in the Tibetan areas of China. Its development in Tibet has experienced two historical stages: the "pre-Hong period" and the "post-Hong period".The complicated religious rituals constitute an important characteristic of Tibetan Buddhism.The second chapter introduces the ethical and moral norms of Tibetan Buddhism.The ethical principles of Tibetan Buddhism mainly include the whole process of going from evil to good, equality and compassion, altruism and so on, including the whole process of a person turning back from evil, improving his self-cultivation and helping others.The moral codes of Tibetan Buddhism include five precepts, ten good, four pictures and six degrees, which constitute a complete system of Tibetan Buddhism ethics.The ethical principles and moral norms of Tibetan Buddhism play a positive role in purifying people's minds, improving people's moral quality, strengthening people's self-discipline, coordinating interpersonal relations, eliminating contradictions and disputes, and stabilizing social order.The third chapter expounds the meaning of crime control and analyzes the feasibility of religious crime control.Crime control is to contain the development of crime, so that it does not exceed a certain range, limit the crime to the normal degree.According to different control stages, crime control can be divided into four aspects: crime prevention (narrow sense), crime control (narrow sense), crime punishment and crime correction.Religion can control crime in three aspects: prior control, event control and post-control.The fourth chapter analyzes the role of Tibetan Buddhism in crime control in Tibet.This paper first introduces the role of Tibetan Buddhism in the control of Tibetan crime in history, and then introduces the functions of social control, moral education and psychological adjustment.The function of social integration in four aspects expounds the role of Tibetan Buddhism in crime control in Tibet.Finally, the author points out that the principle of dialectical analysis and the principle of comprehensive management of Tibetan Buddhism and other means of crime control should be adhered to in crime control by Tibetan Buddhism.
