【摘要】： 全球化已經(jīng)成為當(dāng)今時代最重要的特征。在全球化進程中,世界范圍內(nèi)的法律文化交流與沖突進一步加劇,每個國家和民族都面臨著法律文化的選擇和重構(gòu)問題。本文試圖從全球化視角出發(fā),通過對中西法律文化沖突及演進的歷史和現(xiàn)實考察,揭示其發(fā)展的總體趨勢和規(guī)律,并結(jié)合中國法制建設(shè)的實際,探尋建構(gòu)當(dāng)代中國法律文化的模式和路徑。自近代始,西方法律文化隨著列強的堅船利炮開啟了中國的大門,中國傳統(tǒng)法律文化遭到了巨大沖擊和挑戰(zhàn),傳統(tǒng)的法律秩序遂被瓦解并開始向現(xiàn)代轉(zhuǎn)型。及至全球化時代,隨著改革開放,特別是入世后,中國開始作為一個“對話者”進入世界結(jié)構(gòu)之中,中西法律文化的交流和沖突也隨之加劇,無論是在廣度還是深度上,都比以往時代有了質(zhì)的變化�？傆^中西法律文化沖突之趨勢,必然走向消解與融合。從法律文化發(fā)展的內(nèi)在機理看,共通性和兼容性決定了異質(zhì)法律文化能夠重釋異己,消除對立而達至多元并存。從實踐動因看,沖突之消解與融合還歸因于:一是法律文化全球化之推動,二是中國加入世界結(jié)構(gòu)之必須。那么,全球化時代,在西方現(xiàn)代法治文化沖擊和影響下,當(dāng)代中國法律文化究竟選擇一條什么樣的發(fā)展道路?是立足本土自然演進,還是移植西方變法圖治?本文認(rèn)為,當(dāng)代中國法律文化建構(gòu)應(yīng)立足于傳統(tǒng),同時以放眼世界的開放胸懷,批判借鑒西方法律資源,從而建構(gòu)中國特色的先進法律文化。
[Abstract]:Globalization has become the most important feature of our times.In the process of globalization, the exchange and conflict of legal culture in the world is becoming more and more serious. Each country and nation is faced with the problem of choosing and reconstructing the legal culture.From the perspective of globalization, this paper attempts to reveal the general trend and law of the legal culture conflict and evolution between China and the West through the historical and realistic investigation of its evolution, and to combine with the reality of China's legal system construction.To explore the mode and path of constructing contemporary Chinese legal culture.Since modern times, the western legal culture has opened the door of China with the great strength of the great powers. The traditional legal culture of China has been greatly impacted and challenged, and the traditional legal order has been disintegrated and began to transform to the modern.In the era of globalization, with the reform and opening up, especially after China's accession to the WTO, China began to enter the world structure as a "interlocutor", and the exchanges and conflicts between Chinese and Western legal cultures intensified, both in breadth and depth.Both have changed qualitatively than in previous times.A general view of the trend of conflict between Chinese and Western legal culture is bound to dissolve and merge.From the perspective of the internal mechanism of the development of legal culture, the commonality and compatibility determine that the heterogeneous legal culture can reinterpret dissension and eliminate opposites and achieve pluralistic coexistence.From the perspective of practical motivation, the resolution and integration of conflicts are also attributed to: first, the globalization of legal culture, and second, the necessity of China's entry into the world structure.So, in the era of globalization, under the impact and influence of the western modern legal culture, what kind of development path does the contemporary Chinese legal culture choose?Is it based on native natural evolution, or is it a transplant of Western metamorphosis?This paper holds that the construction of contemporary Chinese legal culture should be based on the tradition, at the same time, with the open mind of looking at the world, criticizing and drawing lessons from the western legal resources, thus constructing the advanced legal culture with Chinese characteristics.
