試論日本律令制對唐制的受容與創(chuàng)新

【摘要】: 中日兩國間的交往源遠流長,日本古代文化的發(fā)展深受中國文化的影響,在律令制度方面尤為突出。因此,研究日本封建律令制的形成,不僅可以印證中日兩國歷史文化相互交融的淵源關系,而且還可以揭示日本封建律令制的特點。本文通過將日本律令制與當時的唐制相比較,進一步闡明東亞中、日兩國的封建國家體制的發(fā)展進程和相互間的異同關系。 第一章為緒論部分,介紹了研究目的及意義、研究現狀、研究的可行性和創(chuàng)新點。 第二章論述日本對唐律令制的引進。 此章對日本引進唐文化的歷史背景進行分析。隋唐時期的中國,正處于封建社會的鼎盛期,經濟、文化繁榮發(fā)達,東亞各國紛紛向隋唐朝貢,并極力發(fā)展與唐的經濟和文化關系,東亞形成了以隋唐為中心的東北亞國際新秩序。而此時的日本,正處于社會的一個動蕩期,各種社會矛盾錯綜復雜,交替發(fā)展。奴隸社會末期的日本,原有的部民奴隸制弊端畢現,已不再適應生產力的發(fā)展,其社會內部潛伏的各種矛盾漸漸浮出水面。這種千變萬化的國際形勢和國內的重重危機,對日本的發(fā)展和安全都形成了巨大壓力和挑戰(zhàn)。面對這種挑戰(zhàn),日本頻繁地向大陸派遣使節(jié),努力學習中國的先進制度。 第三章主要論述日本對唐律令的吸收與創(chuàng)新。 大化改新后,新政府根據當時的實際需要,從668年開始編撰律令,先后修訂完成了《近江令》、《飛鳥凈御原令》。到了8世紀,日本律令建設進入了高潮時期。701年以唐律令為藍本,編撰完成了《大寶律令》,718年,又以其為基礎編撰完成了《養(yǎng)老律令》。至此,日本的中央封建律令體制已經完備,日本成為一個法式完備的中央集權封建制國家。 值得研究的是,日本在吸收唐律令制度時并不是被動的、盲目的,而是積極的、有選擇的。本著創(chuàng)新的精神,在大量繼承唐律令制的基礎上,又以自己本民族文化為依托,摒棄了一部分不合日本國情的內容。把唐律令文化中可借鑒的部分融入到日本文化中,使日本封建體制進入完善階段,并在此過程中形成自己的特色。 第四章論述日本律令制對日本社會,乃至整個東亞社會的影響。 日本實施律令制度之后,對日本社會產生了極大的影響。一方面,律令制實施以后使日本的中央集權體制發(fā)展到了新的階段;另一方面,律令制的實施使日本確立了東亞大國的地位,成為僅次于唐朝的第二強國。 伴隨著日本律令體制的確立,東亞漢字文化圈日趨穩(wěn)固,為中朝日三國在各個領域進行廣泛交流奠定了堅實的基礎。 第五章為結論部分。
[Abstract]:The exchanges between China and Japan have a long history. The development of ancient Japanese culture is deeply influenced by Chinese culture, especially in the legal system.Therefore, the study of the formation of Japanese feudal law system can not only confirm the historical and cultural relationship between China and Japan, but also reveal the characteristics of Japanese feudal law system.By comparing the Japanese legal system with the Tang system at that time, this paper further clarifies the development process and the similarities and differences of the feudal state system between China and Japan in East Asia.The first chapter is the introduction, which introduces the purpose and significance of the research, the research status, the feasibility and innovation of the research.The second chapter discusses Japan's introduction of Tang law system.This chapter analyzes the historical background of Japan's introduction of Tang culture.During the Sui and Tang dynasties, China was in the heyday of feudal society. The economy and culture were prosperous and developed. East Asian countries paid tribute to the Sui and Tang dynasties one after another, and tried their best to develop the economic and cultural relations with the Tang Dynasty.East Asia formed a new international order in Northeast Asia with Sui and Tang dynasties as the center.At this time, Japan is in a period of social turbulence, various social contradictions complex, alternate development.At the end of slave society in Japan, the former malpractice of local slavery was not adapted to the development of productive forces, and the latent contradictions within the society gradually surfaced.This ever-changing international situation and various domestic crises have brought great pressure and challenge to Japan's development and security.In the face of this challenge, Japan frequently sent envoys to the mainland to study China's advanced system.The third chapter mainly discusses Japan's absorption and innovation of Tang law.After the reform of Dahua, the new government began to compile laws and decrees in 668 according to the actual needs at that time, and successively revised and completed the "order near the River" and the "order of the Flying Birds to purify the Imperial Yuan".In the eighth century, the construction of Japanese laws and decrees entered the climax period. 701 based on the Tang Dynasty, completed the "Da Bao Law", 718 years, and based on it to complete the "pension law".At this point, Japan's central feudal law system has been completed, Japan has become a French complete centralized feudal country.What is worth studying is that Japan is not passive, blind, but positive and selective in absorbing the Tang law system.In the spirit of innovation and on the basis of inheriting the system of laws and decrees of Tang Dynasty, and relying on his own national culture, he abandoned some contents which were not in accordance with the national conditions of Japan.The part of Tang law culture that can be used for reference is integrated into Japanese culture to make the Japanese feudal system enter the perfect stage and form its own characteristics in the process.Chapter four discusses the influence of Japanese legal system on Japanese society and even the whole East Asian society.After the implementation of the legal system in Japan, it had a great impact on Japanese society.On the one hand, the implementation of the law system made the centralization system of Japan develop to a new stage; on the other hand, the implementation of the law system made Japan establish its status as a big country in East Asia and become the second largest country after the Tang Dynasty.With the establishment of the Japanese legal system, the East Asian cultural circle of Chinese characters is becoming more and more stable, which lays a solid foundation for the extensive exchanges between China, Korea and Japan in various fields.The fifth chapter is the conclusion.
