【摘要】：公共理性是一種公共化的思維方式和合作共治的公民能力,對于轉(zhuǎn)型期社會具有重大意義。公共理性是理性的公共化,是一種使"理性"步入"合理性"的觀念,其基本要素包含主體的平等性和目標(biāo)的公共性。對于法治的建設(shè)與發(fā)展,公共理性是其必然內(nèi)涵和重要基礎(chǔ),因?yàn)楣怖硇钥梢詼y量法治社會的水平,公共理性與法治社會密不可分。公共理性的形成在實(shí)踐上說就是一個公權(quán)與私權(quán)不斷溝通的過程,而司法透明指數(shù)、電子政府發(fā)展指數(shù)和余杭法治指數(shù)等一系列法治實(shí)踐在公權(quán)與私權(quán)層面對公共理性的培育都具有現(xiàn)實(shí)作用。因而,中國法治實(shí)踐學(xué)派的提出初衷和重要任務(wù)之一就是要著眼于轉(zhuǎn)型的中國社會,經(jīng)由法治實(shí)踐培育出普遍的公共理性,整合力量以共建法治社會。
[Abstract]:Public rationality is a public mode of thinking and the ability to cooperate and govern together, which is of great significance to the transitional society.Public rationality is the publicity of rationality and the concept of "rationality". Its basic elements include the equality of the subject and the publicity of the goal.For the construction and development of the rule of law, public rationality is its inevitable connotation and important foundation, because public rationality can measure the level of the society ruled by law, and public rationality is inseparable from the society ruled by law.In practice, the formation of public rationality is a process of continuous communication between public rights and private rights, and the judicial transparency index,A series of legal practice, such as electronic government development index and Yuhang rule of law index, play a practical role in the cultivation of public rationality at the level of public right and private right.Therefore, the original intention and important Ren Wuzhi of the school of practice of rule of law in China is to focus on the transformation of the Chinese society, cultivate universal public rationality through the practice of rule of law, and integrate forces to build a society under the rule of law.
