【摘要】： 在經(jīng)濟(jì)全球化的背景下,資本已成為各國經(jīng)濟(jì)發(fā)展的重要要素。越來越多的發(fā)展中國家通過利用外資達(dá)到增強(qiáng)本國資本,吸引和利用外資是這些國家國民經(jīng)濟(jì)發(fā)展的動(dòng)力之一。通過制定投資法律來吸引外國直接投資是當(dāng)今世界經(jīng)濟(jì)發(fā)展的潮流之一,發(fā)展中國家紛紛通過制定外資法以吸引外資。因此投資法律作為投資社會(huì)環(huán)境的因素之一,在所有投資環(huán)境中首先被投資者考慮的。 蘇丹在擺脫殖民統(tǒng)治取得獨(dú)立后,在很長的一段時(shí)間內(nèi)限制外資的進(jìn)入,國民經(jīng)濟(jì)發(fā)展緩慢,成為世界上最不發(fā)達(dá)國家之一。20世紀(jì)90年代以來,蘇丹政府實(shí)行對(duì)外開放政策,并逐步擴(kuò)大開放的廣度和深度,吸收外國投資與擴(kuò)大國際貿(mào)易合作。為改善其國內(nèi)投資環(huán)境,給外來投資者越來越優(yōu)惠的條件,制定和修訂引進(jìn)外國投資的規(guī)章和具體措施,在投資法方面也已經(jīng)形成了一定規(guī)模的投資法體系。蘇丹對(duì)外資政策的明顯改變?yōu)橥鈬顿Y者創(chuàng)造了有利的投資環(huán)境,形成了利用外資的高潮。 蘇丹是我國對(duì)非洲直接投資的重點(diǎn)國家之一,也是我國對(duì)非洲投資最多的國家。在世界“投資非洲熱”的影響下,我國對(duì)非洲投資法的研究越來越多。但是,目前國內(nèi)對(duì)非洲投資法的研究還不多,且不系統(tǒng)、不深入。本文在資料收集過程中收集了蘇丹的《鼓勵(lì)投資法》及其配套法規(guī),系統(tǒng)的介紹了蘇丹投資法律制度的主要內(nèi)容并分析了蘇丹投資立法和相關(guān)措施的價(jià)值,從而系統(tǒng)、全面的了解蘇丹投資法律環(huán)境。并通過對(duì)蘇丹的投資法內(nèi)容的分析,研究蘇丹的投資法律環(huán)境；最后分析蘇丹投資法對(duì)中國在蘇丹投資的影響,并提出中國對(duì)蘇丹投資如何抓住機(jī)遇及規(guī)避風(fēng)險(xiǎn)的建議。 我國應(yīng)抓住蘇丹以優(yōu)惠政策吸引外資的機(jī)遇,保持現(xiàn)有的投資優(yōu)勢(shì),加大在蘇丹能源領(lǐng)域的投資規(guī)模,滿足我國經(jīng)濟(jì)發(fā)展對(duì)能源的需求。增加在工業(yè)領(lǐng)域的投資,推動(dòng)我國生產(chǎn)能力過剩產(chǎn)業(yè)的轉(zhuǎn)移。我國還應(yīng)抓住蘇丹投資政策的轉(zhuǎn)變的先機(jī),加大對(duì)蘇丹實(shí)施投資多元化戰(zhàn)略,從而有效調(diào)整我國產(chǎn)業(yè)結(jié)構(gòu),實(shí)現(xiàn)產(chǎn)業(yè)的梯度大轉(zhuǎn)移。
[Abstract]:Under the background of economic globalization, capital has become an important factor in the economic development of various countries. Attracting and utilizing foreign capital is one of the driving forces of the national economic development of these countries. It is one of the current trends of the world economic development to attract foreign direct investment by making investment laws. Developing countries have adopted foreign investment laws to attract foreign investment. Therefore, investment law, as one of the factors of investment social environment, is considered by investors in all investment environments. After the Sudan gained independence from colonial rule and restricted the entry of foreign capital for a long time, the national economy developed slowly and became one of the least developed countries in the world. Since the 1990s, the Sudanese Government has implemented the policy of opening up to the outside world. And gradually expand the scope and depth of opening up, absorb foreign investment and expand international trade cooperation... in order to improve their domestic investment environment and give more and more favorable conditions to foreign investors, they shall formulate and revise regulations and specific measures for the introduction of foreign investment, The obvious change of Sudan's foreign investment policy has created a favorable investment environment for foreign investors and formed the climax of utilizing foreign capital. Sudan is one of the key countries of our direct investment in Africa, and it also has the most investment in Africa. Under the influence of "investing in Africa" in the world, our country has been studying more and more African investment laws. At present, there is not much research on African investment law in China, and it is not systematic and in-depth. In the course of data collection, this paper collects the Sudan's Investment encouragement Act and its supporting laws and regulations. This paper systematically introduces the main contents of Sudan's investment legal system and analyzes the value of Sudanese investment legislation and related measures, so as to systematically and comprehensively understand the Sudan's investment legal environment, and through the analysis of Sudan's investment law content, This paper studies the investment legal environment of Sudan, and finally analyzes the influence of Sudanese investment law on Chinese investment in Sudan, and puts forward some suggestions on how to seize the opportunity and avoid the risk of Chinese investment in Sudan. China should seize the opportunity of the Sudan to attract foreign capital with preferential policies, maintain its existing investment advantages, increase the scale of investment in the Sudan's energy field, and meet the energy needs of China's economic development, and increase its investment in the industrial field, In order to adjust the industrial structure of our country effectively, we should grasp the opportunity of the transformation of Sudan's investment policy, increase the strategy of investment diversification to Sudan, and realize the gradient transfer of industry.
