【摘要】：法律文化是法學(xué)理論的重要組成部分。隨著時(shí)代的不斷進(jìn)步和發(fā)展，法律文化也隨之發(fā)展。目前，，中國正處在社會主義法治建設(shè)偉大實(shí)踐的進(jìn)程中，構(gòu)建符合中國具體國情的現(xiàn)代法律文化有著非常重要的現(xiàn)實(shí)意義。本文以傳統(tǒng)法律文化現(xiàn)代化為切入點(diǎn)，詳細(xì)的分析了中國傳統(tǒng)法律文化和西方法律文化對我國法律文化現(xiàn)代化的影響。以此為基礎(chǔ)，要想實(shí)現(xiàn)傳統(tǒng)法律文化現(xiàn)代化不但要批判中國傳統(tǒng)法律文化當(dāng)中的消極因素，還要繼承中國傳統(tǒng)法律文化中的積極因素，合理借鑒西方法律文化的優(yōu)秀成果，培植和構(gòu)建符合中國特殊國情的社會主義先進(jìn)法律文化，完善社會主義現(xiàn)代化的法律制度體系。 本文的內(nèi)容除引言和結(jié)語外，一共有四個(gè)部分。通過對傳統(tǒng)法律文化的分析解讀以及對西方法律文化的沖擊影響的分析，結(jié)合我國的具體國情，對中國傳統(tǒng)法律文化現(xiàn)代化的路徑進(jìn)行了初步的探析。主要內(nèi)容如下： 第一部分主要是對中國傳統(tǒng)法律文化的概述。此部分主要介紹了文化的含義以及中國傳統(tǒng)法律文化的含義和特征，分析了中國傳統(tǒng)法律文化的價(jià)值。從而使我們對傳統(tǒng)法律文化有著更深刻的理解，為后面的論述打下基礎(chǔ)。 第二部分介紹了中國傳統(tǒng)法律文化現(xiàn)代化的涵義與發(fā)展。此部分主要介紹了中國傳統(tǒng)法律文化現(xiàn)代化的含義、目標(biāo)，以及中國傳統(tǒng)法律文化現(xiàn)代化的歷史動因，此外，還詳細(xì)的描述了中國傳統(tǒng)法律文化現(xiàn)代化的歷史進(jìn)程。 第三部分從全球化和時(shí)代的角度出發(fā)，論述了中國傳統(tǒng)法律文化現(xiàn)代化的必要性，此部分圍繞著中國傳統(tǒng)法律文化現(xiàn)代化的內(nèi)在要求以及中國傳統(tǒng)法律文化與現(xiàn)代社會發(fā)展不適應(yīng)這兩個(gè)角度剖析了中國傳統(tǒng)法律文化現(xiàn)代化的必要。 第四部分則是通過對前三部分傳統(tǒng)法律文化的介紹和分析，探析了中國傳統(tǒng)法律文化現(xiàn)代化的方向和路徑。這部分主要從四個(gè)角度出發(fā)，首先是要批判的繼承中國傳統(tǒng)法律文化；其次要合理借鑒西方法律文化的優(yōu)秀成果；再次，培植和構(gòu)建符合中國國情的社會主義先進(jìn)法律文化；最后，完善社會主義現(xiàn)代化的法律制度體系。
[Abstract]:The legal culture is an important part of the legal theory. With the development of the times, the legal culture also develops. At present, China is in the process of the great practice of the construction of the socialist rule of law. It is of great practical significance to construct a modern legal culture in accordance with the specific conditions of China. This paper takes the modernization of traditional legal culture as the starting point. This paper analyzes in detail the influence of Chinese traditional legal culture and western legal culture on the modernization of Chinese legal culture. On this basis, if we want to realize the modernization of traditional legal culture, we should not only criticize the negative factors in Chinese traditional legal culture, It is also necessary to inherit the positive factors in Chinese traditional legal culture, use the outstanding achievements of western legal culture for reference reasonably, cultivate and construct the advanced socialist legal culture in accordance with China's special national conditions, and perfect the legal system of socialist modernization. In addition to the introduction and conclusion, the content of this paper has four parts. Through the analysis of the traditional legal culture and the impact on the western legal culture, combined with the specific situation of our country, This paper makes a preliminary analysis on the way of modernization of Chinese traditional legal culture. The main contents are as follows:. The first part is an overview of Chinese traditional legal culture. This part mainly introduces the meaning of culture and the meaning and characteristics of Chinese traditional legal culture. This paper analyzes the value of Chinese traditional legal culture, which makes us have a deeper understanding of the traditional legal culture and lays a foundation for the following discussion. The second part introduces the meaning and development of the modernization of Chinese traditional legal culture. This part mainly introduces the meaning and goal of the modernization of Chinese traditional legal culture, as well as the historical motivation of the modernization of Chinese traditional legal culture. It also describes the historical process of modernization of Chinese traditional legal culture in detail. The third part discusses the necessity of the modernization of Chinese traditional legal culture from the angle of globalization and the times. This part analyzes the necessity of the modernization of Chinese traditional legal culture from two angles: the inherent requirement of the modernization of Chinese traditional legal culture and the unsuitability of the Chinese traditional legal culture and the development of modern society. In the 4th part, through the introduction and analysis of the first three parts of the traditional legal culture, the author analyzes the direction and the way of the modernization of the Chinese traditional legal culture. Firstly, we should critically inherit the traditional Chinese legal culture; secondly, we should learn from the outstanding achievements of the western legal culture reasonably; thirdly, we should cultivate and construct the advanced socialist legal culture in accordance with the national conditions of China; finally, We will improve the legal system of socialist modernization.
