【摘要】：20世紀(jì)70年代,為應(yīng)對(duì)嚴(yán)重的老年虐待問題,美國(guó)多數(shù)州立法均確立了強(qiáng)制報(bào)告制度,對(duì)報(bào)告的主體、報(bào)告的情形與內(nèi)容、未能報(bào)告的責(zé)任以及報(bào)告的例外情況等方面作了規(guī)定。為實(shí)施該制度,美國(guó)各州出臺(tái)了加強(qiáng)報(bào)告責(zé)任人的專業(yè)培訓(xùn)、提高老年人的維權(quán)意識(shí)、為受虐老人提供服務(wù)等多項(xiàng)措施。在我國(guó),新修訂的《老年人權(quán)益保障法》雖然對(duì)老年虐待行為及其責(zé)任進(jìn)行了較為詳細(xì)的規(guī)定,但幾乎沒有關(guān)于發(fā)現(xiàn)和預(yù)防老年虐待行為的規(guī)定。為此,應(yīng)當(dāng)借鑒美國(guó)強(qiáng)制報(bào)告制度,明確老年虐待的內(nèi)涵,及時(shí)確立強(qiáng)制報(bào)告制度,并加強(qiáng)配套措施的建設(shè)。
[Abstract]:In 1970s, in order to deal with the serious problem of elder abuse, most American state legislations established the mandatory reporting system, the main body of the report, the situation and content of the report. Responsibility for failure to report and exceptions to reporting are provided for. In order to implement the system, states in the United States have introduced professional training for those responsible for the report to raise awareness of the rights of older persons. In China, although the newly amended Law on the Protection of the Rights and interests of the elderly provides for more detailed provisions on elder abuse and its liability, However, there is almost no provision for the detection and prevention of elder abuse. Therefore, we should draw lessons from the United States compulsory reporting system, clarify the connotation of elder abuse, establish the mandatory reporting system in time, and strengthen the construction of supporting measures.
