【摘要】： 情理審判是中國傳統(tǒng)訴訟頗具特色的訴訟審判現(xiàn)象。情理審判在中國傳統(tǒng)訴訟中有其廣闊的生存發(fā)展空間,司法官在審判時經(jīng)常出現(xiàn)既依照法律又照顧情理的情形,當法律和情理相沖突時,司法官經(jīng)常舍法求情。本文以清代的情理審判為研究對象,對清代情理審判的表達與實踐及其對現(xiàn)代司法的影響與啟示進行探析。 全文共分四個部分,首先在引言中以當今學界對清代司法審判依據(jù)的爭論為出發(fā)點,介紹學界對情理法和清代司法制度的研究狀況,提出本文擬論述的幾個問題。 在第一章中,筆者專門就“情”、“理”的涵義進行界定,探討“情理審判”的歷史發(fā)展進程、情理審判的作用與特點。 在第二章中,對情理審判如何在清代司法審判的表達和實踐中得以體現(xiàn)作了專門論述。在本章中,筆者試圖通過以個案分析的方法來探討情理審判在清代民事訴訟和刑事訴訟領域中的實踐與運用。 在第三章中,從多個角度分析了情理審判在清末走向衰微的原因,論述了情理審判在中國司法審判現(xiàn)代化進程中的影響,認為情理審判不僅在清代的審判中有其生存的空間,在現(xiàn)今的司法審判中也常能見到其身影,并形成了當今所謂訴訟人情化的現(xiàn)象。 最后,通過分析,筆者認為傳統(tǒng)的情理審判對當今司法審判改革仍具有積極意義的因素,對情理審判在中國當今司法審判制度改革的作用進行探討,以期對中國的法治建設有所借鑒。
[Abstract]:The reason is the trial judge Chinese characteristics of the phenomenon of traditional litigation. A reasonable trial has a broad space for the survival and development of China in traditional litigation, both in accordance with the law and reasonable care situation often appear in the judicial officer at the trial, when the conflict between law and reason, judicial officials often give law to intercede. Taking reasonable trial in the Qing Dynasty as the research object, the expression and practice of the reasonable trial in Qing Dynasty and its influence on the modern judicial analysis and enlightenment.
The full text is divided into four parts. First, in the preface, starting from the debates on the basis of judicature in Qing Dynasty, this paper introduces the academic research on the law of reason and the judicial system in Qing Dynasty, and puts forward several problems discussed in this paper.
In the first chapter, the author defines the meaning of "love" and "reason", and discusses the historical development process of "rational judgment" and the role and characteristics of the rational trial.
In the second chapter, on how to reasonable trial in the expression and practice of justice in Qing Dynasty reflected are specially discussed. In this chapter, the author tries to practice and use case analysis method to explore the reasonable trial in civil litigation and criminal litigation in the field.
In the third chapter, analyzes the reasons of reasonable trial in the late Qing Dynasty declined from multiple angles, discusses the influence of reasonable trial in China judicial trial in the process of modernization, that the reasonable trial has not only the living space in the Qing Dynasty during the trial in the judicial trial are often able to see its shadow, and the formation of the so-called litigation human phenomenon.
Finally, through analysis, the author thinks that the traditional sense of justice is still a positive factor for today's judicial reform, and explores the role of the rational trial in the judicial system reform in China, hoping to learn from the rule of law in China.
