【摘要】： 規(guī)范性法律文件中的模糊詞語,是指在規(guī)范性法律文件中,某些缺乏明確可指“語言對象”的概括性的詞語。它既不是含混不清的法律用語,也不是立法多義詞。 規(guī)范性法律文件中的模糊詞語除了具有一般模糊詞語的屬性之外,還具有內(nèi)核的精確性和意義的待明性。所謂內(nèi)核的精確性,是指規(guī)范性法律文件中,模糊詞語的詞義邊緣部分是模糊的,而詞義中心部分則是清晰的。所謂意義的待明性,是指規(guī)范性法律文件中,模糊詞語的詞義是抽象概括的規(guī)范意義,因此在司法裁判中有待情境化或解釋說明。 規(guī)范性法律文件中的模糊詞語可根據(jù)其模糊表現(xiàn)分為內(nèi)部模糊的立法詞語和外部模糊的立法詞語,也可根據(jù)其立法作用分為概括性立法詞語、補(bǔ)充性立法詞語和描述性立法詞語,還可根據(jù)其詞語表達(dá)式上的差異分為邊界模糊的詞語和模糊限制語。 規(guī)范性法律文件中之所以用語模糊,有人類認(rèn)識和思維方面的原因,有人類語言方面的原因,也有法律本身的原因。 模糊詞語在規(guī)范性法律文件中的應(yīng)用,對法治建設(shè)而言,既有積極的功能,也有消極的作用。因此,既要探尋確定模糊詞語意義的方法,又要探尋限制文件表述過度模糊的方法。首先,可以應(yīng)用于分析規(guī)范性法律文件中模糊詞語的詞義分析方法,包括語素分析法、多義詞辨析法和近義詞分析法等。其次,針對語言表述過度模糊的規(guī)范性法律文件,有必要采取限制模糊語言的原則和手段。
[Abstract]:The vague words in the normative legal documents refer to some general words which lack the explicit reference to the "language object" in the normative legal documents, and they are neither ambiguous legal terms nor legislative polysemous words. The fuzzy words in normative legal documents not only have the attributes of general fuzzy words, but also have the precision of the kernel and the clarity of the meaning. The so-called precision of the core refers to the normative legal documents. The edge part of the word meaning of the fuzzy words is fuzzy, while the central part of the word meaning is clear. Therefore, in the administration of justice, there is a need for contextualization or explanation. The fuzzy words in normative legal documents can be divided into internal fuzzy legislative words and external fuzzy legislative words according to their fuzzy expression, and also can be divided into general legislative words according to their legislative functions. Supplementary legislative words and descriptive legislative words can also be divided into fuzzy words and hedges according to their differences in expressions. The reason why the terms of normative legal documents are vague are the reasons of human cognition and thinking, the reasons of human language, and the reasons of law itself. The application of fuzzy words in normative legal documents has both positive and negative functions for the construction of the rule of law. Therefore, it is necessary to explore the method of determining the meaning of fuzzy words. First of all, it can be used to analyze the meaning of fuzzy words in normative legal documents, including morpheme analysis, polysemous analysis and synonym analysis. It is necessary to adopt the principle and means of limiting vague language in view of the normative and legal documents which are excessively vague in language expression.
