【摘要】： 我國的政治經(jīng)濟體制改革不斷深化,現(xiàn)在處于社會轉(zhuǎn)型時期,各種社會矛盾凸顯,建設法治社會刻不容緩。法治社會目標的實現(xiàn)要以社會成員法律意識的提高為條件。對于農(nóng)民占了人口絕大部分的中國來說,農(nóng)民法律意識教育是我們必須面對的一個重要問題。當代農(nóng)民法律意識現(xiàn)狀是不容樂觀,但是在提高我國當代農(nóng)民法律意識方面,當前我們教育的誤區(qū)在于重視具體法律知識的培育卻忽視了法治精神的啟蒙,在法律工具主義的影響下,針對農(nóng)民的法律意識教育存在教育目標定位的低層次、教育出發(fā)點的功利性、教育內(nèi)容的不符合農(nóng)民需要、教育方式的陳舊等問題。此外,整個社會法治環(huán)境對農(nóng)民法律意識的影響作用也是舉足輕重的。 當代中國提高農(nóng)民法律意識是建設社會主義新農(nóng)村的需要,是發(fā)展民主政治建設法治國家的需要,是提升國家競爭力的需要。農(nóng)民法律意識教育內(nèi)容方面,法律精神的啟蒙是法律意識教育的根本,在此基礎(chǔ)上培育農(nóng)民的憲法意識和基本權(quán)利意識,其次應當加強市場經(jīng)濟環(huán)境中與農(nóng)民利益相關(guān)的法律法規(guī)的教育,增強農(nóng)民的權(quán)利義務觀念。還有,向來被我們忽視的一個問題,就是要看到整個國家和社會是一個有機的整體,要把農(nóng)民法律意識的教育放在整個制度架構(gòu)的大背景下進行研究。要改善法律意識教育的社會環(huán)境,深化政治體制改革,依法執(zhí)政,完善司法體制。因為法律意識教育的實效性和優(yōu)良的社會法治環(huán)境是分不開的。法律意識教育的過程也是伴隨著法治社會實現(xiàn)的過程,二者相輔相成,互相促進。
[Abstract]:The reform of our country's political and economic system is deepening, and it is now in the period of social transformation. It is urgent to build a society ruled by law. The realization of the goal of a society ruled by law must be conditioned by the improvement of the legal consciousness of the members of the society. For China, where farmers make up the vast majority of the population, The education of peasants' legal consciousness is an important problem that we must face. The present situation of peasants' legal consciousness is not optimistic, but in improving our country's contemporary peasants' legal consciousness, At present, the misconception of our education lies in paying attention to the cultivation of specific legal knowledge but neglecting the enlightenment of the spirit of rule of law. Under the influence of legal instrumentalism, there is a low level of the orientation of educational goal in the legal consciousness education for farmers. The utilitarianism of the starting point of education, the unconformity of educational contents with the needs of farmers, the old ways of education, etc. In addition, the influence of the whole social legal environment on the peasants' legal consciousness is also very important. In contemporary China, it is necessary to build a new socialist countryside, to develop democratic politics, to build a country ruled by law and to enhance the competitiveness of the country. The enlightenment of legal spirit is the foundation of legal consciousness education. On this basis, we should cultivate farmers' consciousness of constitution and basic rights. Secondly, we should strengthen the education of laws and regulations related to the interests of peasants in the market economy environment. To enhance the rights and obligations of peasants. Moreover, a problem that has always been overlooked by us is to see the whole country and society as an organic whole. We should put the education of peasants' legal consciousness under the background of the whole institutional framework, improve the social environment of legal awareness education, deepen the reform of the political system, and govern according to law. To perfect the judicial system, because the effectiveness of the legal consciousness education and the fine social legal environment are inseparable. The process of the legal consciousness education is also accompanied by the realization of the rule of law society, they complement each other and promote each other.
