【摘要】：中國特色社會主義法律體系形成之后,中國特色社會主義法治體系成為黨和國家依法治國理論和實踐的主要法治目標。與"法律體系"相比,"法治體系"從"法律的生命在于實施"這個基本認識出發(fā),更加注重實踐、更加關注法律文本變?yōu)楝F(xiàn)實法律關系,因而,行動要素成為法治體系的一個基礎性制度分析理路。中國特色社會主義法治體系的主要行動要素包括:依法執(zhí)政、科學立法、嚴格執(zhí)法、公正司法和全民守法。每個行動要素都是具有法律意義的行為,五個行動要素之間具有密切的相關性。
[Abstract]:After the formation of the socialist legal system with Chinese characteristics, The socialist legal system with Chinese characteristics has become the main goal of ruling the country by law in the theory and practice of ruling the country according to law. Compared with the "legal system", the "legal system" starts from the basic understanding that "the life of the law lies in the implementation of the law". Pay more attention to practice, pay more attention to the legal text and turn the legal relation into reality, therefore, the action element becomes a basic system analysis road of the rule of law system. The main action elements of the socialist rule of law system with Chinese characteristics include: ruling by law, Scientific legislation, strict law enforcement, just administration of justice and law-abiding by the whole people. Each action element is an act of legal significance, and there is a close correlation between the five action elements.
