【摘要】：通過創(chuàng)新司法制度以回應環(huán)境問題帶來的挑戰(zhàn),印度成為世界上第一個制定《綠色法庭法》的國家。該法的成功經(jīng)驗及存在的局限性給中國以重要啟示:環(huán)境權法定是環(huán)境司法發(fā)展的前提和基礎;環(huán)境糾紛性質影響環(huán)境法庭構建;接近正義權是環(huán)境司法制度的核心內涵;合法性依據(jù)是環(huán)境法庭構建和環(huán)境司法發(fā)展的制度保障;法律制度也可以幫助實現(xiàn)環(huán)境正義。
[Abstract]:Responding to the challenges posed by environmental issues through innovative justice systems, India has become the first country in the world to formulate the Green Court Law. The successful experience and limitations of this law have given China important enlightenment: environmental right law is the premise and foundation of the development of environmental justice; The nature of environmental disputes affects the construction of environmental courts; the right to justice is the core connotation of the environmental justice system; the legal basis is the institutional guarantee of the construction of environmental courts and the development of environmental justice; the legal system can also help to achieve environmental justice.
