【摘要】：形式和實(shí)質(zhì)是法治在現(xiàn)代語境中最主要的爭論之一,兩者對(duì)于正當(dāng)性和個(gè)別性問題作出了截然不同的回答。然而,遵循純粹的實(shí)質(zhì)法治或者形式法治都有可能誤入歧途。中國的法治發(fā)展不應(yīng)當(dāng)依賴某種既定的模式,而應(yīng)該吸收法治中的形式和實(shí)質(zhì)因素,結(jié)合自身問題,在法治的剛性與柔性之間找到平衡點(diǎn)。
[Abstract]:Form and substance are one of the most important arguments about the rule of law in the modern context. They have different answers to the questions of legitimacy and individualism. Following a purely substantive rule of law or formal rule of law is likely to go astray. China's development of the rule of law should not rely on a certain established pattern, but should absorb the formal and substantive factors in the rule of law and combine with its own problems. Find a balance between the rigidity and flexibility of the rule of law.
