【摘要】：一般說來,法律秩序是一種具有特殊強(qiáng)制力的社會狀態(tài),為社會提供確定性、一致性,為社會主體提供安全保障,為社會關(guān)系提供可依循的界限和規(guī)則。然而,此種關(guān)于法律秩序的論說,雖然指出了法律作為一種制度在社會秩序形成與發(fā)展中的作用,卻忽視了法感情對于守法行為以及守法者的意義。也正因如此,中國幾十年法制建設(shè)雖收獲頗豐,卻大都僅限于書本層面與法律人口號式的吶喊中,而現(xiàn)實(shí)中法律秩序之構(gòu)建并不理想。基于此,本文將以法感情缺失為進(jìn)路,尋探社會生活中法律秩序未能形成之原因,為社會法秩序之構(gòu)建與踐行提供參考。
[Abstract]:Generally speaking, legal order is a kind of social state with special coercive power, which provides certainty and consistency for society, security for social subjects, boundaries and rules for social relations. This argument on legal order, while pointing out the role of law as a system in the formation and development of social order, ignores the significance of legal feelings for law-abiding behaviour and law-abiding persons. Although the legal system construction in China has gained a lot in the past decades, it is mostly confined to the slogan cry of the book and the legal person, but the construction of the legal order in reality is not ideal. Based on this, this paper will take the lack of legal feelings as the way to go. To find out the reasons why the legal order in social life has not been formed, and to provide reference for the construction and practice of social legal order.
