【摘要】：當(dāng)前我國(guó)正處于社會(huì)轉(zhuǎn)型期和矛盾凸顯期，弱勢(shì)群體的問題逐漸暴露并日益引起政府和人民的關(guān)注。保護(hù)社會(huì)弱勢(shì)群體的權(quán)利，不僅是基本人權(quán)的要求，更是社會(huì)正義的基本要求。法律作為調(diào)節(jié)社會(huì)關(guān)系和平衡社會(huì)利益的重要手段，只有對(duì)弱勢(shì)群體提供足夠的權(quán)利保護(hù)，才能促進(jìn)社會(huì)的和諧與穩(wěn)定。基于對(duì)弱勢(shì)群體權(quán)利法律保護(hù)的重要性的認(rèn)識(shí)，本文從法律正義的角度入手，對(duì)弱勢(shì)群體保護(hù)的法律正義缺失及其完善做了深入的探討。 本文首先對(duì)弱勢(shì)群體進(jìn)行了法學(xué)意義上的界定，進(jìn)而分析了法律必須保護(hù)弱勢(shì)群體的法律依據(jù)，有憲法依據(jù)、基本法依據(jù)、專門法依據(jù)、實(shí)然法依據(jù)四種。在對(duì)弱勢(shì)群體保護(hù)的過程中，即這幾種法的具體實(shí)踐操作中，實(shí)踐呼喚法律正義的介入。法律正義與其他正義比如說道德正義不同。法律正義無論在實(shí)質(zhì)上還是形式上的核心都是正義，法律正義是為了維護(hù)正義而在法律層面達(dá)到的使得法律能夠按照正義標(biāo)準(zhǔn)運(yùn)行的一種價(jià)值目標(biāo)，同樣它也是在法理原則規(guī)范上和法律使用的過程中都要遵從的基本前提。接著本文結(jié)合我國(guó)的實(shí)際情況從立法、執(zhí)法、司法三個(gè)層面對(duì)弱勢(shì)群體的法律保護(hù)進(jìn)行研究，提出了弱勢(shì)群體保護(hù)存在法律上的缺失和正義上的缺失。由此，立法機(jī)關(guān)必須明確立法原則，，不斷彌補(bǔ)法律漏洞，強(qiáng)化弱勢(shì)群體保護(hù)的制度建設(shè)，進(jìn)一步完善社會(huì)轉(zhuǎn)型期法律正義實(shí)現(xiàn)的法律規(guī)范。執(zhí)法機(jī)關(guān)要依法執(zhí)法，在執(zhí)法過程中注重法律正義保護(hù)好弱勢(shì)群體的切身利益。司法機(jī)關(guān)要完善司法救助制度，為弱勢(shì)群體在訴訟過程中提供便利。只有立法機(jī)關(guān)、執(zhí)法機(jī)關(guān)、司法機(jī)關(guān)三管齊下才能更好的保護(hù)我國(guó)弱勢(shì)群體，實(shí)現(xiàn)法律正義。
[Abstract]:At present, our country is in the period of social transition and contradictions, the problems of the vulnerable groups are gradually exposed and increasingly aroused the attention of the government and the people. The protection of the rights of the social vulnerable groups is not only the requirement of basic human rights. Law, as an important means of regulating social relations and balancing social interests, only provides adequate protection of the rights of vulnerable groups. Based on the understanding of the importance of the legal protection of the rights of the vulnerable groups, this paper, from the perspective of legal justice, makes a deep discussion on the lack and perfection of the legal justice of the protection of the vulnerable groups. This paper first defines the vulnerable groups in the sense of law, and then analyzes the legal basis on which the law must protect the vulnerable groups, the constitutional basis, the basic law basis, and the special legal basis. In the process of protecting vulnerable groups, that is, in the concrete practice of these methods, Practice calls for the intervention of legal justice. Legal justice is different from other justice, such as moral justice. The core of legal justice is justice, whether in substance or form. Legal justice is a kind of value goal which can make the law run according to the standard of justice in order to maintain justice. It is also the basic premise to be followed in the process of legal principle and legal application. Then this paper studies the legal protection of vulnerable groups from the three aspects of legislation, law enforcement and judicature according to the actual situation of our country. Therefore, the legislature must make clear the principle of legislation, make up the legal loophole and strengthen the system construction of the protection of vulnerable groups. To further improve the legal norms for the realization of legal justice in the period of social transformation. Law enforcement agencies should enforce the law according to law, pay attention to legal justice in the course of law enforcement to protect the vital interests of vulnerable groups, and judicial organs should improve the system of judicial assistance. Only the legislative organs, law enforcement agencies and judicial organs can better protect the vulnerable groups in our country and achieve legal justice.
