【摘要】：農民工法律援助制度是中國特色的法律救助機制和特殊的法律援助形式,具有典型的時代轉型性和農民工群體特性。農民工法律援助制度有其內涵邏輯和價值意蘊,但也存在制度性、操作性局限,筆者以西安市區(qū)農民工的問卷調查數據為支撐,對農民工法律援助制度的困境進行了制度、程序、經費和主體層面的解讀,并認為堅持健全制度、強化保障、完善渠道、加大普法的"四位一體"路徑是當下優(yōu)化農民工法律援助制度的應然之舉。
[Abstract]:The legal aid system of migrant workers is a special legal aid system with Chinese characteristics, which has the characteristics of the transition of the times and the group of migrant workers. The legal aid system of migrant workers has its connotation logic and value implication. However, there are institutional and operational limitations. Based on the survey data of rural migrant workers in Xi'an urban area, the author interprets the plight of the legal aid system of migrant workers from the aspects of system, procedure, funds and subject. The author thinks that it is necessary to improve the legal aid system of migrant workers at present by insisting on perfecting the system, strengthening the guarantee, perfecting the channel and increasing the "four-in-one" path of popularizing the law.
