【摘要】：北愛爾蘭是英國領(lǐng)土的一部分,由于民族和宗教問題,素來沖突不斷。二戰(zhàn)后,北愛爾蘭問題愈加突出。英國自20世紀(jì)60年代開始,在處理北愛沖突中,堅持走和平推進(jìn)的道路,歷經(jīng)半個世紀(jì),成功解決了北愛關(guān)于地方自治的問題,為多民族國家和地區(qū)處理類似問題提供了經(jīng)驗并樹立了典范。本文筆者力求從法理學(xué)的角度,探索北愛成功解決地方自治的原因,并深入探討地方自治的法理學(xué)依據(jù),從中提煉出值得我國借鑒的經(jīng)驗。全文共分為三個部分： 第一部分運用了歷史的研究方法,細(xì)致闡述殖民主義時期、愛爾蘭分治時期、宗教對立時期、第一次和平進(jìn)程時期以及第兩次和平進(jìn)程及其各屆政府的政策、法案的歷史,從歷史和法學(xué)的角度梳理北愛爾蘭問題的由來,以及英國在和平進(jìn)程時期處理北愛爾蘭的政策。 第二部分運用比較分析法對英國處理北愛爾蘭地方自治政策進(jìn)行分析。首先闡述英國地方自治的發(fā)展,全面分析英國素來有著地方自治傳統(tǒng)的原因。進(jìn)而對比和平進(jìn)程時期的歷次法案,分析地方自治,特別是自治權(quán)在北愛各時期法案中的演進(jìn),以及英國在處理北愛問題中思維的轉(zhuǎn)變和一些具體的做法。 第三部分從法學(xué)角度來總結(jié)為什么英國在北愛爾蘭地方自治的問題上可以取得成功。詳細(xì)闡述地方自治的法理基礎(chǔ),全面分析實行地方自治的法理學(xué)依據(jù),以及如何保障地方自治的權(quán)力。進(jìn)而從北愛爾蘭問題的和平解決中得出啟示,來為我國在處理少數(shù)民族地方自治的問題上提供可借鑒的經(jīng)驗。
[Abstract]:Northern Ireland is part of British territory and has been in constant conflict over ethnic and religious issues. After World War II, Northern Ireland became increasingly problematic. Britain, since 1960s, has been dealing with the conflict in Northern Ireland. Sticking to the path of peaceful advancement has successfully solved the problem of local autonomy in Northern Ireland after half a century, which has provided experience and set an example for multinational countries and regions to deal with similar problems. This paper explores the reasons for the successful solution of local autonomy in Northern Ireland, probes into the jurisprudence basis of local autonomy, and abstracts from it the experience that our country can learn from it. The full text is divided into three parts:. The first part uses historical research methods to elaborate on the history of colonialism, Irish partition, religious antagonism, the first peace process, the second peace process and the policies of their respective governments, as well as the history of bills, From the point of view of history and law, the origin of Northern Ireland and the British policy of dealing with Northern Ireland during the peace process. The second part uses the comparative analysis method to analyze the British local self-government policy in Northern Ireland. By comprehensively analyzing the reasons why Britain has always had the tradition of local self-government, and comparing the successive bills of the peace process, and analyzing the evolution of local self-government, especially the right of self-government, in the bills of various periods in Northern Ireland, And Britain's change of mind in dealing with Northern Ireland and some specific practices. The third part sums up why Britain can succeed in the question of local autonomy in Northern Ireland from the angle of law. And how to protect the power of local autonomy, and then draw inspiration from the peaceful settlement of the Northern Ireland problem, to provide our country with reference experience in dealing with the problem of minority local autonomy.
