中韓兩國海上災(zāi)難處理合作研究

【摘要】: 和平與發(fā)展成為時代主題的今天,全球化和地區(qū)合作迅猛發(fā)展。在一定區(qū)域內(nèi)的相鄰國家之間,基于自然條件的相似性,并且歷史上政治和經(jīng)濟(jì)聯(lián)系較為密切,出于共同發(fā)展的需要,雙方之間進(jìn)行合作的可能性就比較大,具體到中韓兩國之間,同屬東方儒家文化圈,有著近千年的交往歷史,二戰(zhàn)以來基于社會制度的差異交往中斷,但是隨著時代的發(fā)展,兩國逐漸意識到,相互交往合作符合兩國之間的利益,1992年兩國正式建交,隨后兩國關(guān)系迅速升溫,交往層次不斷加深,2008年兩國之間確立了“戰(zhàn)略合作伙伴關(guān)系”,為兩國其他領(lǐng)域的合作提供了平臺和支撐。中韓兩國之間涉海管理機(jī)構(gòu)的合作正是在這樣的背景下展開。 海洋是文明的搖籃,帶給人類無盡的財富,但是變幻莫測的海洋也會給人類帶來巨大的災(zāi)難,尤其是近代以來,隨著船舶發(fā)展的大型化,海難往往給人類帶來難以想象的損失,巨型油輪的出現(xiàn),海上溢油污染給人類帶來巨大經(jīng)濟(jì)損失的同時也造成難以補(bǔ)救的環(huán)境危害。每一個沿海國家都在積極改革發(fā)展本國的涉海管理機(jī)構(gòu)以應(yīng)對越來越重大的海上災(zāi)難,中國在探索集中管理模式的道路上前行,而韓國則在集中管理的模式上建立起了豐富的經(jīng)驗,對比中韓兩國涉海管理模式的改革發(fā)展發(fā)現(xiàn)兩個國家的探索任重而道遠(yuǎn)。 面對日益嚴(yán)重的海上災(zāi)難,中韓兩國分別建立了自己的危機(jī)處理機(jī)構(gòu)和應(yīng)急隊伍。在海上搜救方面,中國海上搜救中心的建立協(xié)調(diào)了相關(guān)機(jī)構(gòu)共同應(yīng)對隨時可能發(fā)生的海上危險,韓國也在《救難救護(hù)法》框架下確立了以韓國海洋警察廳為主導(dǎo)的海上搜集體系。為了更有效的救助海上人員和財產(chǎn),《中韓海上搜救協(xié)定》及其《履行協(xié)定》的簽署標(biāo)志著兩國海上搜救合作進(jìn)入了新階段。在溢油處理方面,中國交通運(yùn)輸部海事局及沿海各省、市級政府致力于建立三位一體的海上溢油應(yīng)急反應(yīng)體系,韓國也建立了以海洋警察廳為主導(dǎo),地方社團(tuán)共同參與的溢油應(yīng)急處理體系,在西北太平洋行動計劃(NOWPAP)框架下中韓兩國建立了溢油合作關(guān)系,并成功的于2008年在中國青島舉行了溢油應(yīng)急聯(lián)合演習(xí)。 回顧中韓兩國之間涉海管理機(jī)構(gòu)的合作歷史,總結(jié)合作現(xiàn)狀,中韓兩國涉海管理機(jī)構(gòu)在海上災(zāi)難應(yīng)對方面還有若干方面需要改進(jìn)和加強(qiáng)。作為韓國海洋警察廳的一員,筆者在工作中也參與到了中韓兩國海洋合作中來,總結(jié)合作的成績,展望合作的發(fā)展,希望能夠?qū)χ许n兩國之間涉海機(jī)構(gòu)的進(jìn)一步合作起到有益效用。
[Abstract]:Today, peace and development are the theme of the times, globalization and regional cooperation are developing rapidly. Among the neighboring countries in a certain region, there are similarities based on natural conditions, and political and economic ties have been relatively close in history. Due to the need for common development, the possibility of cooperation between the two sides is relatively large. Specifically, the two countries, both of which belong to the Eastern Confucian cultural circle, have a history of nearly one thousand years of communication, and exchanges based on differences in social systems have been interrupted since the second World War. However, with the development of the times, the two countries gradually realized that mutual exchanges and cooperation were in the interests of the two countries. In 1992, the two countries formally established diplomatic relations, and subsequently the relations between the two countries quickly heated up. In 2008, the strategic cooperative partnership was established between the two countries, which provided the platform and support for the cooperation in other fields between the two countries. The ocean is the cradle of civilization, bringing mankind endless wealth, but the unpredictable sea will also bring great disasters to mankind, especially in modern times, with the development of ships on a large scale, Shipwrecks often bring unimaginable losses to mankind, the emergence of giant oil tankers, Oil spill pollution at sea has caused enormous economic losses to mankind and irreparable environmental harm. Every coastal country is actively reforming and developing its own maritime regulatory agencies to cope with the growing maritime disaster. China is on the way of exploring centralized management mode, while South Korea has established rich experience on centralized management mode. Comparing the reform and development of China and South Korea's management mode involving sea, we find that the two countries have a long way to go. In the face of an increasingly serious maritime disaster, China and South Korea have respectively established their own crisis management agencies and emergency teams. In the area of maritime search and rescue, The establishment of the China Maritime search and Rescue Center has coordinated efforts by relevant agencies to deal with possible maritime hazards at any time. Korea has also established a maritime collection system under the framework of the "rescue and rescue law". In order to more effectively rescue people and property at sea, the "china-Korea maritime search and rescue agreement" and its "implementation agreement" The signing marks the beginning of a new phase in maritime search and rescue cooperation between the two countries. The maritime affairs bureau of China's Ministry of Transport and coastal provinces and municipal governments are committed to the establishment of a trinity oil spill emergency response system. South Korea has also established an oil spill emergency response system led by the Marine Police Agency and jointly attended by local associations. Under the framework of the Northwest Pacific Action Plan (NPAP), China and South Korea established oil spill cooperation relations, and successfully held a joint oil spill emergency exercise in Qingdao, China on 2008. Recalling the history of cooperation between China and South Korea concerning the management of maritime affairs and summarizing the current situation of cooperation, there are a number of areas in which the maritime disaster management agencies of China and South Korea need to be improved and strengthened... as a member of the Korea Marine Police Agency, The author has also participated in the maritime cooperation between China and Korea in the work, summarizes the achievements of the cooperation, looks forward to the development of cooperation, hoping to play a beneficial role in the further cooperation between China and South Korea.
