【摘要】: 本文研究了1895——1910年中國近代著作權(quán)思想的發(fā)展變化過程,全文共分為六個(gè)部分。 引言部分,對(duì)著作權(quán)思想史研究的現(xiàn)狀,研究意義及選題的價(jià)值、思路等做一個(gè)較為全面的介紹和評(píng)價(jià)。 第一章,近代中國著作權(quán)思想產(chǎn)生、發(fā)展的歷史背景。有觀點(diǎn)認(rèn)為近代中國的“版權(quán)保護(hù)制度完全是受‘外來因素'的影響”,此觀點(diǎn)雖有些絕對(duì),但也可以看出國外著作權(quán)思想對(duì)近代中國著作權(quán)思想的影響,所以在本章中要對(duì)這種影響加以考察。 第二章,官方在近代中國著作權(quán)思想形成、確立中所起的作用。他們主張保護(hù)著作權(quán)但存在分歧,并且他們保護(hù)著作權(quán)的思想既不同于國內(nèi)知識(shí)分子的觀點(diǎn),也不同于西方的著作權(quán)思想,造成差異的主要原因在于三方的立場(chǎng)、背景不同。 第三章,民間對(duì)近代中國著作權(quán)思想形成、確立的影響。一個(gè)完整的圖書市場(chǎng)應(yīng)包括著作者、出版者和讀者,對(duì)著作權(quán)產(chǎn)生影響的主要為前二者,后者的需求雖有影響,但礙于材料限制而很難詳細(xì)研究。近代知識(shí)分子的著作權(quán)要求促進(jìn)了著作權(quán)的發(fā)展;出版者的思想變化對(duì)著作權(quán)立法也產(chǎn)生了很大的影響。 第四章,著作權(quán)思想法律化的完成,即《大清著作權(quán)律》的頒布。這體現(xiàn)了當(dāng)時(shí)中國政府對(duì)著作權(quán)的一個(gè)認(rèn)可,該法出臺(tái)前的修改過程體現(xiàn)了清政府的思想變化。 結(jié)語,把近代中國著作權(quán)思想放在整個(gè)近代中國法律轉(zhuǎn)型的過程中進(jìn)行考察,并分析著作權(quán)思想的變化對(duì)中國知識(shí)界、出版界及民族創(chuàng)造力的保護(hù)作用及保護(hù)著作權(quán)的可行性。 本文的研究方法。本文運(yùn)用歸納法,研究了國內(nèi)外對(duì)于中國著作權(quán)思想的影響。運(yùn)用社會(huì)學(xué)的方法,研究著作權(quán)思想對(duì)中國近代知識(shí)分子的影響。運(yùn)用分析方法,分析了造成國內(nèi)外著作權(quán)思想差異的原因?傊,運(yùn)用大量的史料,分析了各方對(duì)中國近代著作權(quán)思想產(chǎn)生、發(fā)展所產(chǎn)生的影響。在結(jié)論上,做到了論由史出。
[Abstract]:This paper studies the development and change of copyright thought in modern China from 1895 to 1910, which is divided into six parts. In the foreword, the author introduces and evaluates the status quo, significance, value and thinking of the study of copyright history. The first chapter, the historical background of the emergence and development of the copyright thought in modern China. There is a view that the copyright protection system in modern China is completely influenced by the 'external factors', although this view is somewhat absolute. But we can also see the influence of foreign copyright thought on modern Chinese copyright thought, so we should investigate this influence in this chapter. The second chapter, the role of the official in the formation and establishment of modern Chinese copyright thought. They advocate the protection of copyright, but there are differences, and their ideas of copyright protection are different from the views of domestic intellectuals. Also different from the western copyright thought, the main reason for the difference lies in the tripartite position and background. The third chapter, the folk influence on the formation and establishment of modern Chinese copyright thought. A complete book market should include the authors, publishers and readers, the main impact on copyright is the first two. Although the demand of the latter has influence, it is difficult to study it in detail because of the limitation of material. The publisher's thought change also produced the very big influence to the copyright legislation. Chapter 4th, the completion of the legalization of copyright thought, that is, the promulgation of the copyright Law of the Qing Dynasty, which reflected the recognition of copyright by the Chinese government at that time. The amendment process before the promulgation of the law reflected the change of the Qing government's ideas. In conclusion, we put the copyright thought of modern China in the course of the legal transformation of modern China, and analyze the change of copyright thought to the intellectual circle of China. The protection of publishing and national creativity and the feasibility of copyright protection. This paper uses induction to study the influence of domestic and foreign on the thought of copyright in China, and applies the method of sociology. This paper studies the influence of copyright thought on the intellectuals in modern China. By using the analytical method, it analyzes the causes of the differences in copyright thought at home and abroad. In short, it uses a large amount of historical data. This paper analyzes the influence of various parties on the emergence and development of copyright thought in modern China.
