【摘要】：民拿害民官吏是明朝朱元璋統(tǒng)治時期對奸貪害民官吏實行的一種糾舉與制裁措施。朱元璋通過頒布詔令、編制《大誥》公布典型案例等方式,號召平民百姓將奸貪作惡、擾民害民官吏綁縛押解送京予以重處。民拿害民官吏這一治吏措施,是朱元璋個人品格和重典治吏及使民安居樂業(yè)政策相結(jié)合的必然選擇,它既達到了對官吏奸貪害民的懲處與防范,又實現(xiàn)了體恤民眾、愛民富民的社會效果。民拿害民官吏,在訴訟程序上是有別于直訴的特別訴訟,在國家行政管理上它突破了里甲、戶籍及人員流動管制的法律規(guī)定,在立法上它是由特別法規(guī)定的特別制度,在法律適用上它打破了等級特權(quán)制度,從社會效果來看,它實現(xiàn)了中國歷史上極其罕見的平民百姓對官吏的直接監(jiān)督。
[Abstract]:During the reign of Zhu Yuanzhang in the Ming Dynasty, the civil officials were subjected to criminal and corrupt practices and sanctions. Zhu Yuanzhang promulgated the imperial edict, compiled the Letters Patent and published the typical cases, and so on. The common people are called upon to commit mischief and corruption and torment the people and the civil officials to be bound and escorted to Beijing to be remanded. The people take this measure of dealing with the officials of the people. Zhu Yuanzhang's personal character and the policy of governing the officials and making the people live and work in peace and contentment were the inevitable choice. It not only achieved the punishment and prevention of the rape and greed of the government officials, but also realized compassion for the people. The social effect of loving the people and enriching the people. The civil officials are different from the direct litigation in the procedure of litigation. In the administration of the state, it breaks through the legal provisions of the control of Lijia, household registration and the movement of personnel. In legislation, it is a special system stipulated by the special law. In the application of the law, it breaks the system of hierarchical privilege. From the social effect, it realizes the direct supervision of the officials by the ordinary people who are extremely rare in the history of China.
