南非調(diào)解仲裁委員會(huì)研究

【摘要】: 南非調(diào)解仲裁委員會(huì)是在新南非成立后,依據(jù)1995年勞動(dòng)關(guān)系法成立的勞動(dòng)爭議解決機(jī)構(gòu)。它的建立借鑒了歷史上出現(xiàn)的幾個(gè)爭議解決機(jī)構(gòu)的爭端解決模式。南非的勞動(dòng)爭議解決制度的產(chǎn)生與發(fā)展可以分為以下階段:白人單元?jiǎng)趧?dòng)爭議解決機(jī)制階段;黑白二元?jiǎng)趧?dòng)爭議解決體制;對黑白二元?jiǎng)趧?dòng)爭議解決制度改革;南非調(diào)解仲裁委員會(huì)的成立。南非調(diào)解仲裁委員會(huì)的法律淵源主要有1996年南非憲法,1997年基本就業(yè)條件法,1998年平等就業(yè)法,1999年技能開發(fā)法,2001年失業(yè)保險(xiǎn)法,南非調(diào)解仲裁委員會(huì)程序行為規(guī)則等。 南非調(diào)解仲裁委員會(huì)的宗旨在于通過制度化的調(diào)解、仲裁提供簡單的勞動(dòng)爭議處理程序,因此它的主要職能是調(diào)解和仲裁勞動(dòng)爭議。在處理勞動(dòng)爭議時(shí),委員會(huì)遵循著獨(dú)立性,救濟(jì)保護(hù)最大化,爭議解決效率性,調(diào)解前置,強(qiáng)制仲裁,仲裁終局的基本原則。1995年勞動(dòng)關(guān)系法以及隨后的修正案,以及調(diào)解仲裁委員會(huì)行為規(guī)則逐漸為其提供了制度化的爭議解決程序,對各種程序進(jìn)行了清晰的界定。 南非調(diào)解仲裁委員會(huì)在整個(gè)勞動(dòng)爭議解決機(jī)制中占有特殊地位。與其他勞動(dòng)爭議解決機(jī)構(gòu)之間在業(yè)務(wù)上互相聯(lián)系。勞動(dòng)法院對委員會(huì)既有監(jiān)督,也有支持。談判委員會(huì)作為集體談判機(jī)構(gòu),被賦予了解決與集體協(xié)議有關(guān)的爭議的職能,且在調(diào)解仲裁委員會(huì)的授權(quán)下,還可以行使調(diào)解仲裁委員會(huì)的職能。南非獨(dú)立調(diào)解委員會(huì)是成立于20世紀(jì)80年代初提供調(diào)解、仲裁服務(wù)的非政府組織,在南非調(diào)解仲裁委員會(huì)成立之初提供了人力、經(jīng)驗(yàn)上的支持。在南非調(diào)解仲裁委員會(huì)走上正軌后,于2000年停止運(yùn)行。2001年2月成立的Tokiso公司填補(bǔ)了這一空白,作為南非最大的私人爭議解決機(jī)構(gòu)仍然在南非勞動(dòng)爭議解決機(jī)制中發(fā)揮著重要作用,與南非調(diào)解仲裁委員會(huì)并存,從專業(yè)化的角度入手,彌補(bǔ)了南非調(diào)解仲裁委員會(huì)的能力不足。 在實(shí)際運(yùn)營中,南非調(diào)解仲裁委員會(huì)向世人證明了它的成就:可進(jìn)入性提高,解決率提高,解決速度快。但是也面臨著挑戰(zhàn):案件提交率過高,處理效率不能達(dá)到預(yù)期目的,部分委員不稱職,案件處理出現(xiàn)低質(zhì)量問題等等。委員會(huì)的資源無法支撐對它的過高期望。這些問題提醒我們勞動(dòng)爭議解決機(jī)構(gòu)的管轄權(quán)應(yīng)與其能力相適應(yīng),采用ADR的勞動(dòng)爭議解決機(jī)制不應(yīng)設(shè)計(jì)太多的技術(shù)規(guī)則。
[Abstract]:The South African Conciliation Arbitration Commission was established after the establishment of the new South Africa. A labor dispute settlement body established under the Labor Relations Act of 1995. Its establishment draws lessons from the dispute settlement models of several dispute settlement bodies in history. The birth and Development of the Labor dispute settlement system in South Africa. It can be divided into the following phases:. White unit labor dispute settlement mechanism stage; Black and white dual labor dispute settlement system; Reform of black and white labor dispute settlement system; The main legal sources of the South African Conciliation Arbitration Commission are the South African Constitution of 1996, the basic conditions of Employment Act of 1997 and the Equal Employment Act of 1998. 1999 skill Development Act, 2001 unemployment Insurance Act, South African Mediation Arbitration Commission procedure rules, etc. The aim of the South African Conciliation Arbitration Commission is to provide a simple procedure for handling labour disputes through institutionalized mediation, so its main function is to mediate and arbitrate labour disputes... when dealing with labour disputes. The Commission adheres to the basic principles of independence, maximization of relief protection, efficiency of dispute resolution, pre-mediation, compulsory arbitration, and final arbitration. And the rules of conduct of mediation and arbitration commission provide it with systemized dispute settlement procedure gradually, and define all kinds of procedure clearly. The South African Mediation and Arbitration Commission occupies a special position in the whole mechanism of labor dispute settlement. The Independent Conciliation Commission of South Africa was established in early 1980s as a non-governmental organization providing conciliation and arbitration services. Manpower and empirical support was provided at the beginning of the establishment of the South African Conciliation Arbitration Commission. Once the South African Conciliation Arbitration Commission was on track. It stopped running on 2000. Tokiso, founded in February 2001, filled the gap. As the largest private dispute settlement institution in South Africa, it still plays an important role in the South African labor dispute settlement mechanism, coexisting with the South African Mediation and Arbitration Commission, from the perspective of specialization.
