【摘要】： 權(quán)力制約,是現(xiàn)代民主政治的核心問題之一,也是憲法學(xué)所要研究的核心問題之一。權(quán)力是普遍存在于社會中的、合法的、正當?shù)�、能夠改變別人意志的能力。權(quán)力無時無處不在,它是生活中不可缺少的因素。權(quán)力產(chǎn)生的終極目標是為了更好的實現(xiàn)權(quán)力授予人的利益,但是權(quán)力自身上的無限擴張的本性得不到有效的制約與控制,會使權(quán)力結(jié)果的承受者對權(quán)力、對社會感到害怕、恐懼乃至失望,從而違背權(quán)力被授予的初衷。因此如何能讓權(quán)力既維護秩序、發(fā)揮效能,又不侵犯權(quán)利和自由,這就需要對它進行有效的制約,這也是權(quán)力運行的內(nèi)在需要。 馬克思主義是人類歷史上最偉大、最杰出的思想之一,馬克思主義有關(guān)權(quán)力的思想是馬克思思想寶庫的重要組成部分。我國在馬克思、恩格斯偉大導(dǎo)師思想的指導(dǎo)下,逐步探索與完善了我國自己的權(quán)力制約理論,并逐步的規(guī)范化、法治化、制度化。結(jié)合我國歷史背景,面對當前形勢,本文將以憲法學(xué)為視角,分析并建構(gòu)了我國的權(quán)力制約制度。因為人類文明史的發(fā)展進程,證明了這樣一個事實:在法治社會中,只有將國家權(quán)力置于一個有效制約的機制下,才能合理規(guī)范地運行。我國只有充分吸收和借鑒人類優(yōu)秀成果,構(gòu)建結(jié)構(gòu)合理、配置科學(xué)、程序嚴密、制約有效的權(quán)力制約機制,才能真正的實現(xiàn)權(quán)力的效用、更好的推動我國的法治建設(shè)進程。
[Abstract]:Power restriction is one of the core issues of modern democratic politics and also one of the core issues to be studied by constitutional jurisprudence. The ability to change the will of others. Power is everywhere, it is an indispensable factor in life. The ultimate goal of power is to better realize the interests of power. But the nature of unlimited expansion of power itself can not be effectively restricted and controlled, will make the power of the result of the recipient of power, fear and even disappointment of the society. Therefore, how can power not only maintain order and efficiency, but also not infringe on rights and freedoms, which need to be effectively restricted, which is also the inherent need of power operation. Marxism is one of the greatest and most outstanding thoughts in human history. The thought of power in Marxism is an important part of the treasure house of Marx. Under the guidance of Engels' great mentor thought, he gradually explored and perfected our own theory of power restriction, and gradually standardized, ruled by law, institutionalized, combined with the historical background of our country, facing the current situation. This article will analyze and construct the power restriction system of our country from the perspective of constitutional jurisprudence, because the development process of human civilization history proves such a fact: in the society of rule of law. Only by putting the state power under an effective restriction mechanism can we operate reasonably and normatively. In our country, we must fully absorb and draw lessons from the outstanding achievements of mankind, construct a reasonable structure, configure scientifically, and have strict procedures. Only by restricting the effective power restriction mechanism can we realize the utility of power and promote the construction of rule of law in our country.
