【摘要】：加拿大商標(biāo)法無論在商標(biāo)注冊(cè)、商標(biāo)異議、商標(biāo)撤銷還是商標(biāo)侵權(quán)判斷標(biāo)準(zhǔn)上,都無不貫徹這樣一個(gè)準(zhǔn)則:商標(biāo)權(quán)來自于對(duì)商標(biāo)的實(shí)際使用,這也是普通法系國(guó)家對(duì)商標(biāo)權(quán)利來源的一個(gè)基本判斷;商標(biāo)侵權(quán)理論在加拿大的發(fā)展主要體現(xiàn)在商標(biāo)淡化理論的適用上,對(duì)商標(biāo)淡化理論的適用進(jìn)行嚴(yán)格限制,是加拿大法院通過判例向社會(huì)傳達(dá)的司法機(jī)構(gòu)在這個(gè)問題上的基本觀點(diǎn)。對(duì)加拿大商標(biāo)制度的引介和研究,既對(duì)我國(guó)的商標(biāo)法律體系的修改具有借鑒意義,又可以在中加貿(mào)易往來愈加頻繁的背景下,對(duì)中國(guó)企業(yè)在加拿大構(gòu)建商標(biāo)戰(zhàn)略體系提供法律支持。
[Abstract]:No matter in the trademark registration, trademark objection, trademark revocation or trademark infringement judgment standard, the Canadian Trademark Law all carry out such a criterion: trademark right comes from the actual use of trademark. This is also a basic judgment on the origin of trademark rights in common law countries. The development of trademark infringement theory in Canada is mainly reflected in the application of trademark dilution theory, and the application of trademark dilution theory is strictly restricted. The introduction and research of Canadian trademark system can be used as a reference for the revision of our country's trademark legal system. It can also provide legal support for Chinese enterprises to set up trademark strategy system in Canada under the background of more frequent trade contacts between China and Canada.
