【摘要】： 模糊性是自然語言的一個重要特征�！澳：钡母拍詈屠碚撌敲绹刂普搶＜以陆淌�1965年最先在一篇題為“模糊集”的文章中提出來的。而在中國,伍鐵平教授是對模糊語言學(xué)進行系統(tǒng)研究的第一位學(xué)者。他創(chuàng)設(shè)了“模糊語言學(xué)”,并出版了專著《模糊語言學(xué)》。但是將模糊理論與其他語體諸如新聞?wù)Z體、廣告語體、法律語體等結(jié)合起來進行分析,這方面的工作做得還不夠。 法律在我們生活中無處不在。法律通過語言表現(xiàn)出來,語言是法律的載體。模糊性是語言的一個重要特征,所以法律必定會被語言的模糊性所影響。法律語言最鮮明的特點是準(zhǔn)確性和嚴(yán)密性,但并不排除模糊語言的使用。模糊語言客觀地存在于法律語言中。在特定情況下使用一些模糊表達,可以使法律語言達到實質(zhì)上的準(zhǔn)確性和概括性。本文從語義學(xué)角度和語用學(xué)角度出發(fā),討論法律語言中的模糊現(xiàn)象,分析法律語言中存在模糊語言的客觀性和必要性,從語義學(xué)角度對法律模糊語進行分類劃分,從語用學(xué)角度闡述法律模糊語的語用功能。本文在前人研究的基礎(chǔ)上,利用合作原則,禮貌原則和關(guān)聯(lián)理論分析了模糊語言在法律英語中的作用,從語用角度探討了法律語言中的模糊性,從而強調(diào)模糊語言在法律中的重要作用。 本文共分四章。第一章對模糊語言的發(fā)展進行綜述,介紹了模糊語言的定義及幾個重要的模糊概念。第二章介紹了法律語言的發(fā)展?fàn)顩r,并指出法律英語的特點,以及法律語言中存在模糊現(xiàn)象的原因。第三章從語義學(xué)的角度介紹了模糊限制語的定義,并分析了法律語言中模糊限制語的分類及法律文體中模糊限制語的運用和表現(xiàn)。由于本文從語用角度分析法律語言中的模糊現(xiàn)象,所以在第四章中提出幾個重要的語用原則,即合作原則,禮貌原則和關(guān)聯(lián)理論,然后以法律語言為載體,從語用角度對法律語言的模糊性進行分析。論文最后一部分對全文進行總結(jié)并指出其局限性。
[Abstract]:Fuzziness is an important feature of natural language. The concept and theory of "fuzziness" was first put forward by American cybernetics expert Professor Zade in 1965 in an article entitled "Fuzzy set". Professor Wu Tieping was the first scholar to systematically study fuzzy linguistics. He created Fuzzy Linguistics and published his monograph Fuzzy Linguistics. Advertising style, legal style and other combined analysis, this work is not enough. Law is everywhere in our life. Law is expressed through language. Language is the carrier of law. Vagueness is an important feature of language. Therefore, the law is bound to be influenced by the vagueness of language. The most distinctive feature of legal language is accuracy and rigour. But it does not rule out the use of fuzzy language. Fuzzy language exists objectively in legal language. Some vague expressions are used in certain circumstances. This paper discusses the ambiguity in legal language from the perspective of semantics and pragmatics. This paper analyzes the objectivity and necessity of vague language in legal language and classifies it from the perspective of semantics. On the basis of previous studies, this paper analyzes the role of vague language in legal English by using the principles of cooperation, politeness and relevance. This paper discusses the fuzziness in the legal language from the pragmatic point of view and emphasizes the important role of the vague language in the law. This paper is divided into four chapters. The first chapter summarizes the development of fuzzy language, introduces the definition of fuzzy language and several important fuzzy concepts. The second chapter introduces the development of legal language. It also points out the characteristics of legal English and the causes of vagueness in legal language. Chapter three introduces the definition of hedges from the perspective of semantics. It also analyzes the classification of hedges in legal language and the application and expression of hedges in legal style. So in Chapter 4th, we put forward several important pragmatic principles, namely, the principle of cooperation, the principle of politeness and the theory of relevance, and then take the legal language as the carrier. This paper analyzes the fuzziness of legal language from a pragmatic point of view. The last part of the thesis summarizes the full text and points out its limitations.
