【摘要】：無幸福,則無發(fā)展,至少無真正的發(fā)展。較之于社會(huì)發(fā)展與社會(huì)和諧而言,幸福是社會(huì)法更本質(zhì)的價(jià)值追求。在終極意義上,對幸福之追求是社會(huì)法規(guī)范確立與制度設(shè)計(jì)的價(jià)值導(dǎo)引與最終歸宿。幸福具有多種維度:個(gè)體幸福與主觀幸福是社會(huì)成員自我救贖的場域,而社會(huì)幸福與客觀幸福則是國家與社會(huì)的可作為空間,也是社會(huì)法發(fā)揮作用的"勢力范圍"。社會(huì)法不能回避當(dāng)前我國國民幸福指數(shù)偏低的現(xiàn)實(shí)起點(diǎn),社會(huì)法應(yīng)在公民的自我救贖范圍之外實(shí)現(xiàn)自己的制度擔(dān)當(dāng),即為國民提供更好的社會(huì)環(huán)境和自然環(huán)境,增強(qiáng)國民的公平感,提升國民的價(jià)值感和成就感。
[Abstract]:No happiness, no development, at least no real development. Compared with social development and social harmony, happiness is a more essential value pursuit of social law. The pursuit of happiness is the value guide and final destination of social law norm establishment and system design. Happiness has many dimensions: individual happiness and subjective happiness are the field of social members' self-redemption. Social happiness and objective happiness are the space of the state and society, and are also the "sphere of influence" in which social law plays a role. Social law cannot avoid the realistic starting point of the low national happiness index of our country at present. The social law should realize its own system responsibility outside the scope of citizens' self-redemption, that is, to provide better social environment and natural environment for the citizens, to enhance the sense of fairness of the citizens, and to enhance the sense of value and achievement of the citizens.
