【摘要】：中國特色社會主義法律體系的初步形成標(biāo)志著我國建設(shè)法治中國邁出了堅實的一步,在為法制建設(shè)取得偉大成就感到欣喜的同時,我們應(yīng)該清醒和冷靜地看到在完整的法律制度之下仍然存在著不完善的一面,由于快速立法所導(dǎo)致的法律之間不一致、不銜接、相抵觸、相矛盾等法律沖突的局面大量存在并呈現(xiàn)出蔓延和擴張之勢。這一現(xiàn)象所帶來的深刻挑戰(zhàn)正在成為我國貫徹落實法治中國的前進(jìn)障礙和現(xiàn)實危機,為此有必要引起我們法律學(xué)人廣泛的思考和深入的研究。
[Abstract]:The initial formation of the legal system of socialism with Chinese characteristics marks a solid step forward in the construction of China under the rule of law in our country, and at the same time, the great achievements made in the construction of the legal system are gratifying. We should soberly and calmly see that there is still an imperfect side under the complete legal system, because the laws caused by the rapid legislation are inconsistent, inconsistent and contradictory. Contradictions and other legal conflicts exist in a large number and present the trend of spread and expansion. The profound challenge brought by this phenomenon is becoming an obstacle to the implementation of the rule of law in China and a real crisis. Therefore, it is necessary to arouse the extensive thinking and deep research of our jurists.
