【摘要】：法治除了規(guī)則之治的宏觀層面之外,還存在一個微觀層面:即法律規(guī)則向個體習慣轉化,獲得民眾習慣的支撐。法的本質和習慣的天然親和力為法治習慣的養(yǎng)成提供了現實可能性,具體的法治實踐中,需要將習慣融入立法之中,培養(yǎng)新式公民,發(fā)揮社會精英的示范作用,讓規(guī)則獲得習慣的支撐,讓規(guī)則真正融入民眾生活和個體心靈,從而實現社會法治秩序的微建構。
[Abstract]:In addition to the macro level of rule rule, the rule of law still has a micro level: the transformation of legal rules to individual habits, and the support of people's habits. The possibility of natural essence and affinity of customary law for the rule of law to develop habits of the specific practice of the rule of law, need to be used into legislation, cultivating new citizens, play an exemplary role in the social elite, to acquire a habit rules support, make the rules really into people's life and the individual soul, so as to realize the construction of micro the social order of the rule of law.
