【摘要】：偵查功能發(fā)揮的效果決定整個刑事訴訟的進(jìn)程,其基礎(chǔ)地位必須得到加強(qiáng),因而在"以審判為中心的司法體制改革"語境下對偵查功能的價值實(shí)現(xiàn)進(jìn)行實(shí)證分析有利于改善其效果。偵查具有"揭露、防控、保障"的功能,而發(fā)揮其功能必須對其局限性以及成本進(jìn)行考察,消除其負(fù)面的影響因素。因此,從價值角度剖析偵查功能發(fā)揮中存在的主要問題,有利于認(rèn)清現(xiàn)行偵查存在的缺陷,改善偵查行為,推進(jìn)偵查的良善發(fā)展。
[Abstract]:The effect of investigation function determines the whole process of criminal procedure, and its basic position must be strengthened, so the empirical analysis of the value realization of investigation function in the context of "trial-centered judicial system reform" is beneficial to improve its effect. Investigation has the function of "exposure, prevention and control, guarantee", and its limitations and costs must be investigated to eliminate its negative influencing factors. Therefore, it is helpful to recognize the defects of the current investigation, improve the investigation behavior and promote the good development of the investigation by analyzing the main problems existing in the function of investigation from the point of view of value.
