【摘要】：仇恨犯罪是對社會具有強(qiáng)烈負(fù)面影響,對社會安全與穩(wěn)定造成嚴(yán)重沖擊的類型化刑事案件�；谶@種理解,現(xiàn)階段我國社會頻繁出現(xiàn)的、帶有明顯的仇恨動機(jī)的報(bào)復(fù)社會性犯罪和群體性暴力事件都屬于仇恨犯罪的范疇。對2010年以來國內(nèi)發(fā)生的35起典型仇恨犯罪案例的整理和分析可以發(fā)現(xiàn)仇恨犯罪的深層次影響因素:社會結(jié)構(gòu)性失衡是社會個(gè)體仇恨情緒的邏輯起點(diǎn);社會底層的病態(tài)心理是促生仇恨動機(jī)的初始形態(tài);傳統(tǒng)的法外復(fù)仇文化對仇恨犯罪具有發(fā)酵作用;現(xiàn)階段社會治理中的“壓力控制型”治理模式則對仇恨犯罪具有反向激勵(lì)作用。在全面、客觀認(rèn)識仇恨犯罪產(chǎn)生原因的基礎(chǔ)上,當(dāng)下我國仇恨犯罪的預(yù)防應(yīng)遵循治標(biāo)與治本結(jié)合、打擊與預(yù)防并舉的方針,具體從宏觀、中觀和微觀三個(gè)層面展開。
[Abstract]:Hate crime is a type of criminal case that has a strong negative effect on society and has a serious impact on social security and stability. On the basis of this understanding, at the present stage, the social crime and the group violence with obvious hatred are the category of the hate crime. The analysis of 35 typical cases of hate crime in China since 2010 can find the deep influence factors of hate crime: the social structural imbalance is the logical starting point of the social individual's hatred emotion; The traditional extrajudicial revenge culture has the fermentation effect on the hate crime; the "pressure control type" governance model in the current social governance has the opposite incentive function to the hate crime. On the basis of comprehensive and objective knowledge of the causes of hate crime, the prevention of the hate crime in our country should follow the principle of the combination of the prevention and the cure, the combination of the fight against the prevention and the prevention, in particular from the macroscopic, the mesoscopic and the micro three levels.
