【摘要】： 陽(yáng)泉礦區(qū)是全國(guó)最大的無(wú)煙煤生產(chǎn)基地,在過(guò)去的計(jì)劃經(jīng)濟(jì)體制下,陽(yáng)泉礦務(wù)局是典型的“企業(yè)辦社會(huì)”運(yùn)行模式,其違法犯罪案件的種類比較單一,違法犯罪率較低。但是隨著經(jīng)濟(jì)體制的改革,陽(yáng)泉礦務(wù)局改組為新陽(yáng)國(guó)能股份有限公司和陽(yáng)泉煤業(yè)(集團(tuán))有限公司,舊時(shí)的經(jīng)濟(jì)秩序被打破,隨之發(fā)生的變化不僅是人們的思想和行為模式,還有礦區(qū)的違法犯罪規(guī)律也發(fā)生了改變,在礦區(qū)逐步社會(huì)解組的同時(shí),違法犯罪呈現(xiàn)出青少年犯罪和無(wú)業(yè)人員犯罪比重加大、侵財(cái)犯罪居違法犯罪之首、輕傷害案件多發(fā)的特點(diǎn)。針對(duì)這樣的變化,本文著重分析了導(dǎo)致礦區(qū)違法犯罪產(chǎn)生的原因,指出了應(yīng)當(dāng)采取的預(yù)防和控制措施。 本文第一部分,通過(guò)對(duì)山西省陽(yáng)泉市礦區(qū)2004-2007年案件資料的分類、整理、統(tǒng)計(jì),分析,說(shuō)明了礦區(qū)違法犯罪案件的總體狀況,總結(jié)出了陽(yáng)泉市礦區(qū)違法犯罪主體的年齡特點(diǎn)、違法犯罪案件類型特點(diǎn)、違法犯罪身份構(gòu)成特點(diǎn)。 第二部分,依據(jù)菲利的“犯罪原因三元論”,結(jié)合陽(yáng)泉市礦區(qū)的實(shí)際情況,筆者從人類學(xué)因素、自然因素、和社會(huì)因素三個(gè)方面對(duì)陽(yáng)泉市礦區(qū)違法犯罪案件特點(diǎn)進(jìn)行了原因分析。 第三部分,筆者根據(jù)對(duì)新經(jīng)濟(jì)環(huán)境下陽(yáng)泉市礦區(qū)違法犯罪的特點(diǎn)、原因分析,提出了控制和降低礦區(qū)違法犯罪率的相應(yīng)對(duì)策,以期能在降低礦區(qū)違法犯罪率、構(gòu)建和諧社會(huì)方面做出有益嘗試。
[Abstract]:Yangquan mining area is the largest anthracite production base in China. Under the planned economy system in the past, Yangquan Mining Bureau is a typical operation mode of "enterprise-run society". The type of illegal and criminal cases is relatively single, and the illegal and criminal rate is low. However, with the reform of the economic system, the Yangquan Mining Bureau was reorganized into Xinyang Guoneng Co., Ltd. And Yangquan Coal Industry (Group) Co., Ltd., the old economic order was broken, and the subsequent changes were not only people's thinking and behavior patterns, but also the law of illegal and criminal crimes in the mining area. The crime of infringing money ranks first in the crime of violation of law and crime, and the characteristics of the frequent occurrence of cases of light injury. In view of this change, this paper focuses on the analysis of the causes of illegal crimes in mining areas, and points out the preventive and control measures that should be taken. In the first part of this paper, through the classification, collation, statistics and analysis of the case data from 2004 to 2007 in Yangquan City, Shanxi Province, the overall situation of illegal and criminal cases in mining area is explained, and the age characteristics, types of illegal and criminal cases and the characteristics of illegal and criminal identity in Yangquan mining area are summarized. In the second part, according to Philip's "Triple Theory of causes of Crime", combined with the actual situation of Yangquan mining area, the author analyzes the causes of illegal and criminal cases in Yangquan mining area from three aspects: anthropological factors, natural factors and social factors. In the third part, according to the characteristics and causes of the illegal crime in Yangquan mining area under the new economic environment, the author puts forward the corresponding countermeasures to control and reduce the illegal crime rate in the mining area, in order to make a beneficial attempt in reducing the illegal crime rate in the mining area and building a harmonious society.
