【摘要】：社區(qū)矯正作為舶來品,在我國已經(jīng)有十余年的發(fā)展歷程了。社區(qū)矯正是一種非監(jiān)禁刑罰執(zhí)行制度,是指將符合社區(qū)矯正條件的罪犯置于社區(qū)內(nèi),在判決、裁定或決定確定的期限內(nèi),由專門的國家機(jī)關(guān)主導(dǎo)下,在相關(guān)社會(huì)團(tuán)體和民間組織及社會(huì)志愿者的協(xié)助下,矯正其犯罪心理和行為惡習(xí),并促進(jìn)其順利回歸社會(huì)的非監(jiān)禁刑罰執(zhí)行活動(dòng)。本文首先通過闡述司法行政機(jī)關(guān)執(zhí)行社區(qū)矯正制度的概念、內(nèi)容、意義以及我國現(xiàn)階段社區(qū)矯正的現(xiàn)狀對(duì)文章進(jìn)行鋪墊。緊接著針對(duì)我國司法行政機(jī)關(guān)執(zhí)行社區(qū)矯正制度的責(zé)任和問題進(jìn)行了系統(tǒng)的梳理。繼而再分析了域外發(fā)達(dá)國家中司法行政機(jī)關(guān)執(zhí)行社區(qū)矯正制度的經(jīng)驗(yàn)和優(yōu)勢(shì),對(duì)我國長(zhǎng)遠(yuǎn)發(fā)展起到相應(yīng)的啟示作用。最后通過借鑒國內(nèi)外司法機(jī)關(guān)執(zhí)行社區(qū)矯正制度的已有經(jīng)驗(yàn),逐漸探索出適合我國司法體制改革路徑的社區(qū)矯正制度模式。
[Abstract]:Community correction, as an imported product, has been developing for more than ten years in our country. Community correction is a kind of non-imprisonment penalty execution system, which refers to the non-imprisonment penalty execution activities in which criminals who meet the conditions of community correction are placed in the community, under the leadership of special state organs, with the assistance of relevant social organizations, civil society organizations and social volunteers, and to promote their smooth return to society. First of all, this paper paves the way by expounding the concept, content and significance of community correction system implemented by judicial administrative organs and the present situation of community correction in our country. Immediately after the judicial administrative organs of our country to implement the responsibility and problems of community correction system are systematically combed. Then it analyzes the experience and advantages of judicial administrative organs in implementing community correction system in developed countries, which plays a corresponding role in the long-term development of our country. Finally, by drawing lessons from the existing experience of judicial organs at home and abroad in the implementation of community correction system, the community correction system model suitable for the reform of judicial system in our country is gradually explored.
