公安機(jī)關(guān)對(duì)群體性事件的處置策略研究

【摘要】: 群體性事件是當(dāng)今中國面臨的一個(gè)非常突出的社會(huì)問題,嚴(yán)重影響著我國的社會(huì)穩(wěn)定和長(zhǎng)治久安,黨中央和國務(wù)院對(duì)此非常重視,要求地方黨委政府采取科學(xué)合理的措施處置這類事件,切實(shí)有效地解決好人民群眾需要解決的問題,以防發(fā)生社會(huì)動(dòng)亂。公安機(jī)關(guān)作為國內(nèi)治安的主要保衛(wèi)力量,責(zé)無旁貸地承擔(dān)起處置群體性事件的任務(wù),協(xié)助黨委和地方政府負(fù)責(zé)平息事態(tài),穩(wěn)定秩序。新形勢(shì)的變化和和諧社會(huì)的提出,更是對(duì)公安機(jī)關(guān)的工作提出了更高的要求,一方面要保證事態(tài)的穩(wěn)定,防止發(fā)生暴亂;一方面又要注意處置手段的合理性,禁止侵害人民群眾的人身權(quán)利,保持警民關(guān)系的和諧。如何在這兩者之間找到平衡點(diǎn),做到既能順利完成任務(wù),又能維持警民和諧,是公安機(jī)關(guān)始終應(yīng)該考慮和研究的一個(gè)重要課題。 群體性事件是我國各種復(fù)雜矛盾綜合爆發(fā)的具體表現(xiàn)之一,它近年來之所以頻繁發(fā)生,有著非常深刻的社會(huì)背景。具體而言,群體性事件是由于在我國的社會(huì)轉(zhuǎn)型過程中,經(jīng)濟(jì)體制由計(jì)劃經(jīng)濟(jì)向市場(chǎng)經(jīng)濟(jì)轉(zhuǎn)變,社會(huì)利益激烈調(diào)整,不同階層的矛盾糾紛不斷加深,而社會(huì)治理模式又不能適應(yīng)社會(huì)的發(fā)展變化造成的,這是一種正常的社會(huì)現(xiàn)象,通過合理有效的措施,完全可以對(duì)其進(jìn)行治理。認(rèn)識(shí)到群體性事件爆發(fā)的原因,我們才能找到針對(duì)性的應(yīng)付措施,但是群體性事件的解決是一件長(zhǎng)期性的、系統(tǒng)化的工作,它需要一套整體性的制度設(shè)計(jì),就現(xiàn)階段而言,還不具備徹底解決的條件,我們只能在現(xiàn)有的體制框架內(nèi),改進(jìn)工作方法,已達(dá)到更好的治理效果的目的。 經(jīng)過十幾年的實(shí)戰(zhàn),應(yīng)該說,現(xiàn)在公安機(jī)關(guān)處置群體性事件已經(jīng)積累了一定的經(jīng)驗(yàn),有相對(duì)完善的處置程序和戰(zhàn)術(shù)手段,取得了一定的階段性成果。但是也要看到,不少地方政府仍然存在著把公安機(jī)關(guān)視為處置群體性事件的責(zé)任主體,要求公安機(jī)關(guān)大包大攬?zhí)幹霉ぷ?甚至不分青紅皂白,只想動(dòng)用警力直接進(jìn)行壓制的問題,造成了惡劣的社會(huì)影響。本文認(rèn)為,群體性事件的處置是一項(xiàng)系統(tǒng)性的工作,需要黨委政府統(tǒng)籌負(fù)責(zé),各分管單位相互協(xié)調(diào)合作,公安機(jī)關(guān)只是其中的一個(gè)職能部門,不可能負(fù)責(zé)群體性事件處置的大部分工作,公安機(jī)關(guān)只需在自身的權(quán)責(zé)范圍內(nèi)完成自己的任務(wù)。而在有限的權(quán)責(zé)范圍內(nèi),要改進(jìn)和完善群體性事件的處理工作,公安機(jī)關(guān)必須做到以下幾點(diǎn):一是事前階段,構(gòu)建一個(gè)情報(bào)信息暢通,覆蓋面廣的預(yù)警體系;二是事中階段,通過合理分配警力和使用正確的戰(zhàn)術(shù)策略,確實(shí)提高現(xiàn)場(chǎng)處置的能力;三是善后階段,積極配合黨委政府,解決人民群眾關(guān)心的問題,防止事件反復(fù)。這三個(gè)階段工作的改進(jìn),將有助于緩解當(dāng)前緊張的警民關(guān)系,確實(shí)提高事件的處置效果,解決群體性事件處置工作的困境,這也是本文的主要內(nèi)容和寫作目的。
[Abstract]:Mass incidents are a very prominent social problem facing China today, which seriously affects the social stability and long-term stability of our country, and the CPC Central Committee and the State Council attach great importance to this. The local party committee government is required to take scientific and reasonable measures to deal with such incidents and effectively solve the problems that the people need to solve so as to prevent social unrest. As the main defense force of internal public security, the public security organs are duty-bound to undertake the task of dealing with mass incidents, and assist the party committee and local governments to be responsible for calming the situation and stabilizing order. The changes of the new situation and the proposal of a harmonious society have put forward higher requirements for the work of the public security organs. On the one hand, it is necessary to ensure the stability of the situation and prevent the occurrence of violence; On the one hand, we should pay attention to the rationality of the means of disposal, prohibit infringement of the personal rights of the people, and maintain the harmony of the relations between the police and the people. How to find a balance between the two, so as to not only successfully complete the task, but also maintain the harmony between the police and the people, is an important topic that public security organs should always consider and study. Group events are one of the concrete manifestations of the comprehensive outbreak of various complex contradictions in our country, and the reason why they occur frequently in recent years has a very profound social background. Specifically, the group incident is due to the transformation of the economic system from a planned economy to a market economy, the fierce adjustment of social interests, and the deepening of contradictions and disputes among different strata in the process of social transformation in our country. However, the social governance model can not adapt to the development and changes of society, which is a normal social phenomenon, through reasonable and effective measures, it can be managed. Recognizing the causes of the outbreak of mass incidents, we can find targeted measures to deal with them, but the solution of group incidents is a long-term and systematic work, which requires a set of integrated system design, as far as the present stage is concerned, If we do not have the conditions to solve them thoroughly, we can only improve our working methods within the existing institutional framework and have achieved better governance results. After more than ten years of actual combat, it should be said that the public security organs have accumulated certain experience in dealing with group incidents, have relatively perfect handling procedures and tactical means, and have achieved certain phased results. However, it should also be noted that many local governments still regard the public security organs as the main body responsible for dealing with group incidents, and require the public security organs to undertake the work of handling them in an all-round way, even indiscriminately. Just want to use the police force to directly suppress the problem, resulting in a bad social impact. This paper holds that the handling of mass incidents is a systematic work, which requires the overall planning and responsibility of the party committee and the government, and the coordination and cooperation of the various units in charge of each other, and the public security organs are only one of the functional departments. It is impossible to be responsible for most of the work of handling mass incidents. Public security organs only need to complete their own tasks within the scope of their own powers and responsibilities. Within the limited scope of power and responsibility, in order to improve and improve the handling of group incidents, the public security organs must do the following points: first, in the advance stage, build an early warning system with smooth information and wide coverage; The second is to improve the ability to deal with the scene through the rational distribution of police force and the use of correct tactical strategies in the middle stage of the incident. Third, in the rehabilitation stage, we should actively cooperate with the party committee government, solve problems of concern to the masses of the people, and prevent repeated incidents. The improvement of these three stages will help to alleviate the current tense relationship between the police and the people, really improve the handling effect of the incident, and solve the dilemma of the mass incident management work, which is also the main content and writing purpose of this paper.
