【摘要】：本文通過對我國現(xiàn)行司法鑒定體制和舊體制下的司法鑒定制度帶來的弊端進行了分析與比較,肯定其在特定歷史階段發(fā)揮的作用,同時也對建立與完善司法鑒定體制,更好地為市場經(jīng)濟服務(wù)提出了自己的見解。筆者認為,雖然全國人大常委會《關(guān)于司法鑒定管理問題的決定》(以下簡稱《決定》)構(gòu)建了適合我國國情的司法鑒定改革的基本框架,但仍然有許多亟待解決的問題。通過立法方式修改三大訴訟法和出臺《司法鑒定法》已成為當(dāng)前之要務(wù)。本文從三個方面對現(xiàn)行法律制度中關(guān)于司法鑒定管理、鑒定啟動程序及其存在的問題與對策,作了探索,論述了司法鑒定制度在司法體制改革中的地位、作用及重要意義,統(tǒng)一司法鑒定的管理體制,必將為維護我國司法公平與正義發(fā)揮著重要作用。
[Abstract]:Based on the analysis and comparison of the malpractice brought about by the current judicial identification system in our country and the old system, this paper affirms the role it plays in the specific historical stage, and at the same time establishes and improves the judicial identification system. Better for the market economy service put forward their own views. The author believes that although the decision of the standing Committee of the National people's Congress on the Administration of Judicial expertise (hereinafter referred to as "decision") has constructed the basic framework of judicial expertise reform suitable for the national conditions of our country, there are still many urgent problems to be solved. It has become the most important task to amend the three procedural laws and introduce the Judicial Appraisal Law through legislation. In this paper, the author probes into the problems and countermeasures in the current legal system concerning the administration of judicial expertise, the procedure of starting the appraisal and the existing problems and countermeasures, and discusses the position, role and significance of the system of judicial identification in the reform of the judicial system, and discusses the role and significance of the system in the reform of the judicial system. Unifying the management system of judicial appraisal will play an important role in safeguarding judicial fairness and justice in our country.
