【摘要】：近些年來(lái)，群體信訪突發(fā)事件逐步增多，甚至呈現(xiàn)出高發(fā)態(tài)勢(shì)，成為影響社會(huì)穩(wěn)定的一個(gè)重要因素。目前，，群體信訪突發(fā)事件法律應(yīng)對(duì)越來(lái)越受到重視并逐步付諸實(shí)踐，但是，根據(jù)群體信訪突發(fā)事件法律制度內(nèi)涵和支撐其法律應(yīng)對(duì)的理論，我國(guó)群體信訪突發(fā)事件法律應(yīng)對(duì)體系至今還沒(méi)有形成，這對(duì)及時(shí)有效預(yù)防和解決群體信訪突發(fā)事件是不利的。對(duì)此，本文提出亟需并加強(qiáng)群體信訪突發(fā)事件應(yīng)對(duì)法律制度體系建設(shè)的觀點(diǎn)。 本文圍繞上述觀點(diǎn)，從如下四個(gè)方面展開論述： 第一個(gè)方面，揭示群體信訪突發(fā)事件的利益分配不合理、腐敗現(xiàn)象、法律意識(shí)增強(qiáng)、利益訴求渠道不暢通等成因，指出我國(guó)的特殊國(guó)情決定了當(dāng)前發(fā)生的群體信訪突發(fā)事件帶有明顯的轉(zhuǎn)型期特點(diǎn)，描繪了群體信訪突發(fā)事件法律制度的構(gòu)成（信訪工作制度、信訪突發(fā)事件的預(yù)防制度和處理制度），提出了群體信訪突發(fā)事件法律應(yīng)對(duì)的實(shí)現(xiàn)社會(huì)安全穩(wěn)定、切實(shí)維護(hù)群眾利益的價(jià)值取向，以及應(yīng)遵循的基本原則。 第二個(gè)方面，分析了我國(guó)群體信訪突發(fā)事件法律應(yīng)對(duì)的現(xiàn)狀，包括《信訪條例》、《中華人民共和國(guó)突發(fā)事件應(yīng)對(duì)法》以及其他相關(guān)立法之規(guī)定，指出了我國(guó)目前群體信訪突發(fā)事件法律應(yīng)對(duì)存在的立法缺陷、執(zhí)法缺陷、本末倒置、教育滯后等問(wèn)題。 第三個(gè)方面，強(qiáng)調(diào)了建立和完善群體信訪突發(fā)事件法律制度的必要性。認(rèn)為建立和完善群體信訪突發(fā)事件法律制度是維護(hù)社會(huì)安全穩(wěn)定和解決相關(guān)法律制度缺陷問(wèn)題的必然要求。 第四個(gè)方面，提出了加強(qiáng)群體信訪突發(fā)事件法律制度建設(shè)的建議。認(rèn)為應(yīng)當(dāng)從“防范”、“化解”、“控制”、“權(quán)利救濟(jì)”、“責(zé)任追究”等方面加強(qiáng)制度建設(shè)，堅(jiān)持預(yù)防為主，處置為輔，對(duì)事件處置作出具體規(guī)定，確保對(duì)群體信訪突發(fā)事件的處置做到有法可依、有法必依、執(zhí)法必嚴(yán)、違法必究。
[Abstract]:In recent years, group letters and visits emergencies gradually increased, and even presented a high incidence situation, has become an important factor affecting social stability. At present, more and more attention has been paid to the legal response to group petition emergencies and gradually put into practice. However, according to the connotation of the legal system of group letters and visits and the theories supporting its legal response, So far, the legal response system of group petition emergencies has not been formed in our country, which is disadvantageous to prevent and solve group petition emergencies in a timely and effective manner. In view of this, this paper puts forward the view that it is urgent to strengthen the construction of the legal system to deal with the emergency of group letters and visits. Based on the above-mentioned views, this paper discusses the following four aspects: first, it reveals the causes of unreasonable distribution of interest, corruption, enhancement of legal consciousness, lack of channels of interest appeal, and so on, in the first aspect. It is pointed out that the special situation of our country determines that the current group petition emergencies have obvious characteristics of transition period, and describes the composition of the legal system of group petition emergencies (letter and visit work system). This paper puts forward the value orientation of realizing social security and stability, safeguarding the interests of the masses, and the basic principles that should be followed in the legal response to the emergency events of group letters and visits (prevention system and handling system). In the second aspect, the author analyzes the current situation of the legal response to the emergency incidents of group letters and visits in China, including the regulations on Letters and visits, the Law of the people's Republic of China on the response to Emergencies, and the provisions of other relevant legislation. This paper points out the legislative defects, law enforcement defects, putting the cart before the horse, lagging behind in education and so on, which exist in the legal response to the emergency events of group letters and visits in our country. In the third aspect, it emphasizes the necessity of establishing and perfecting the legal system of group petition emergencies. It is considered that the establishment and perfection of the legal system of mass petition emergencies is an inevitable requirement to maintain social security and stability and to solve the defects of the relevant legal system. The fourth aspect, put forward the suggestion to strengthen the construction of the legal system of group petition emergency. Considering that we should strengthen the system construction from the aspects of "prevention", "defusing", "control", "right relief" and "accountability investigation", adhere to the principle of prevention, and make specific provisions on the handling of incidents, Ensure that there is a law to handle the emergency incidents of group letters and visits, there is a law to be obeyed, the law is strictly enforced, and the violation of the law is prosecuted.
