【摘要】：本文力圖開(kāi)辟一個(gè)新的犯罪學(xué)研究領(lǐng)域——"制度犯罪學(xué)"(institutional criminology)。傳統(tǒng)犯罪學(xué)理論以純實(shí)證的態(tài)度和方法對(duì)個(gè)體因素或社會(huì)結(jié)構(gòu)因素與犯罪現(xiàn)象之間的相關(guān)性進(jìn)行研究,制度犯罪學(xué)則是科學(xué)與權(quán)力或科學(xué)知識(shí)與權(quán)力知識(shí)之間的結(jié)盟,以科學(xué)的態(tài)度和方法,再加上政策學(xué)、政治學(xué)的眼光,研究在既定社會(huì)條件下公共政策與犯罪問(wèn)題之間的相關(guān)性。制度犯罪學(xué)堅(jiān)持認(rèn)為,犯罪問(wèn)題是一個(gè)公共政策問(wèn)題。基于這一認(rèn)識(shí),制度犯罪學(xué)關(guān)注以下具體問(wèn)題:政府在解決犯罪問(wèn)題中的作為如何?在解決犯罪問(wèn)題過(guò)程中政府應(yīng)當(dāng)做什么(should to do)、能夠做什么(can do)、打算或不打算做什么(choose to do or choose not to do)、已經(jīng)做什么(have done)。制度犯罪學(xué)研究使犯罪學(xué)由一門(mén)純粹的實(shí)證科學(xué)走向一門(mén)具有政治獻(xiàn)策功能的決策科學(xué)。
[Abstract]:This paper tries to open up a new research field of criminology-"Institutional Criminology" (institutional criminology). The traditional criminology theory studies the relationship between individual factor or social structure factor and criminal phenomenon with a purely positive attitude and method, while institutional criminology is an alliance between science and power or scientific knowledge and power knowledge. The relationship between public policy and crime under the given social conditions is studied in a scientific attitude and method, in addition to the perspective of policy science and political science. Institutional criminology insists that crime is a public policy issue. Based on this understanding, institutional criminology is concerned with the following specific issues: how does the government act in solving the crime problem? What should the Government do in the process of solving the Crime problem? what (should to do), can do? what (can do), intends or does not intend to do? what (have done). Has been done by (choose to do or choose not to do),? The study of institutional criminology leads criminology from a pure positive science to a policy science with the function of political advice.
