【摘要】：2009年6月,重慶市開展了一場打黑除惡專項斗爭,在這場專項斗爭中,許多盤踞重慶多年的黑惡勢力被徹底鏟除,同時黑惡勢力背后的“保護(hù)傘”也被深刻揭露出來。那些昔日的政法干部,曾經(jīng)的打黑英雄,因經(jīng)受不住金錢與美色的誘惑,在思想上偏離了正確的價值軌跡,在道德上走到了人民的對立面,成為黑惡勢力的“保護(hù)傘”,最終在政治上、職業(yè)上雙亡,成為階下囚。這些教訓(xùn)是慘痛的,是值得我們深思的。痛定思痛,以此為鑒,通過對包庇、縱容黑社會性質(zhì)組織犯罪偵防對策的研究,我們更加清醒地認(rèn)識到當(dāng)前的形勢還十分嚴(yán)峻,要做的工作還很多,面臨的挑戰(zhàn)還異常艱巨,只有對黑社會性質(zhì)組織及其背后的“保護(hù)傘”采取嚴(yán)打態(tài)勢,根本消除黑惡團(tuán)伙滋長的環(huán)境,才能確保打黑除惡斗爭取得最終的勝利。 本文共分三個部分 第一部分,明確包庇、縱容黑社會性質(zhì)組織犯罪的概念和構(gòu)成。所謂包庇、縱容黑社會性質(zhì)組織犯罪是指國家機(jī)關(guān)工作人員利用職權(quán)包庇黑社會性質(zhì)組織或者縱容黑社會性質(zhì)組織進(jìn)行違法犯罪活動的行為。它的實質(zhì)是國家工作人員將人民賦予的,應(yīng)該用于服務(wù)社會的公共權(quán)力以尋租或出讓的方式,為黑社會性質(zhì)組織的違法犯罪活動提供庇護(hù)�，F(xiàn)階段包庇、縱容黑社會性質(zhì)組織犯罪高發(fā),形勢不容樂觀。 第二部分,包庇、縱容黑社會性質(zhì)組織犯罪的主體身份特殊,逃避打擊能力強(qiáng),犯罪的表現(xiàn)形式多樣且手段隱蔽。在案件的偵辦過程中會遇到線索發(fā)現(xiàn)難、調(diào)查取證難、排除干擾難、管轄權(quán)存在沖突等諸多困難。必須高度重視案件的偵辦,精心謀劃、周密部署,制定切實可行的實施方案;成立專案組,打擊“保護(hù)傘”;廣泛發(fā)動群眾,細(xì)致收集整理線索;多措并舉,全面實施抓捕;充分運用審訊策略,分化瓦解對手;全面取證、固證排除證據(jù)間的矛盾,形成證據(jù)鎖鏈;檢察院提前介入,與公安機(jī)關(guān)集約力量、共享資源,協(xié)作辦案。 第三部分,造成包庇、縱容黑社會性質(zhì)組織犯罪的原因是多方面的。既有市場經(jīng)濟(jì)運行的制度層面的原因,又有國家工作人員自身的原因;既有主觀方面的原因,也有客觀方面的原因。防范本類犯罪,不但是杜絕黑社會性質(zhì)組織滋長的重要手段,也是維護(hù)穩(wěn)定的社會秩序的必然需要,更是對加強(qiáng)和鞏固黨的執(zhí)政地位、堅實黨的執(zhí)政基礎(chǔ)、提高黨的執(zhí)政能力具有重大意義。必須構(gòu)建一種良好的工作和生活環(huán)境,讓掌握公權(quán)力的國家工作人員“不愿”、“不敢”、“不能”為黑社會性質(zhì)組織充當(dāng)“保護(hù)傘”。
[Abstract]:In June 2009, Chongqing launched a special struggle against criminal and evil elements. In this special struggle, many criminal and evil forces held in Chongqing for many years were thoroughly eradicated, and the "protective umbrella" behind the criminal and evil forces was also deeply exposed. Those former political and legal cadres, who once fought against the black heroes, because they could not withstand the temptation of money and beauty, deviated from the correct value track in their thinking, went morally to the opposite of the people, and became the "umbrella" of the evil and criminal forces. Eventually, politically and professionally, he died and became a prisoner. These lessons are painful and worth pondering. By studying the countermeasures to shield and connive at the crime investigation and prevention of triad organizations, we are more soberly aware that the current situation is still very serious, that there is still a lot of work to be done and that the challenges we face are extremely arduous. Only when we strike hard at the underworld organizations and their "protective umbrella", and eliminate the environment in which the criminal and evil gangs grow, can we ensure the final victory in the struggle against criminal gangs and their "protective umbrellas". This paper is divided into three parts: the first part is the concept and constitution of concealment and connivance of organized crime. The so-called sheltering, connivance to the crime of the underworld nature organization is the behavior that the functionary of the state organ uses his authority to shield the underworld organization or connive the underworld organization to carry on the illegal and criminal activities. The essence of it is that the state functionaries endow the people with the public power which should be used to serve the society in the way of rent-seeking or transferring to provide asylum for the illegal and criminal activities of the underworld organizations. At present sheltering, connivance the underworld nature organization crime high incidence, the situation is not optimistic. The second part, concealment, connive the underworld nature organization crime the main body identity is special, escapes the attack ability to be strong, the crime manifestation is diverse and the means is concealed. In the course of case investigation, there are many difficulties, such as finding clues, collecting evidence, eliminating interference, conflicts of jurisdiction and so on. We must attach great importance to the investigation and handling of cases, plan carefully, make detailed arrangements, formulate feasible implementation plans; set up special case teams to crack down on the "umbrella"; extensively mobilize the masses to collect and sort out clues carefully; Make full use of interrogation strategy, divide and disintegrate opponents; collect evidence in an all-round way, eliminate contradictions between evidence, form evidence chain; Procuratorate intervene ahead of time, share resources with public security organs, share resources, and cooperate in handling cases. The third part, causes the cover, connives the underworld nature organization crime the reason is many aspects. There are both the reasons of the system level of market economy operation and the reasons of the state functionaries themselves, as well as the reasons of subjective and objective aspects. Preventing this kind of crime is not only an important means to prevent the growth of underworld organizations, but also an inevitable need to maintain a stable social order. It is also necessary to strengthen and consolidate the ruling position of the Party and consolidate its ruling foundation. It is of great significance to improve the ruling ability of the Party. A good working and living environment must be built so that the state functionaries who hold public power are "unwilling", "afraid" and "unable" to act as "protective umbrellas" for triad organizations.
