【摘要】： 競(jìng)技體育作為體育領(lǐng)域的一大分枝,在我國(guó)體育界中長(zhǎng)期占據(jù)重要位置,是我國(guó)重點(diǎn)培養(yǎng)發(fā)展的體育類型。當(dāng)前,隨著我國(guó)競(jìng)技體育事業(yè)發(fā)展速度的加快,以及體育商業(yè)化、市場(chǎng)化的轉(zhuǎn)變,競(jìng)技體育在多方面的利益驅(qū)使下,產(chǎn)生了一些違法亂紀(jì)行為,其中最為典型的是操縱比賽犯罪行為。本文從刑法學(xué)角度出發(fā),結(jié)合我國(guó)《體育法》相關(guān)法條,闡述了競(jìng)技體育中操縱比賽犯罪的三種主要表現(xiàn)形式,其中包括我國(guó)特有的犯罪模式“單位犯罪”作為主要研究對(duì)象。通過對(duì)操縱比賽犯罪的危害性敘述,進(jìn)而揭示司法介入、以法律手段嚴(yán)懲該類犯罪具有必要性和迫切性。我國(guó)應(yīng)借鑒國(guó)外一些發(fā)達(dá)國(guó)家對(duì)于預(yù)防和打擊操縱比賽犯罪的經(jīng)驗(yàn),主要在于立法和執(zhí)法方面的經(jīng)驗(yàn)借鑒,同時(shí)總結(jié)出我國(guó)在處理該類犯罪時(shí)存在的問題和不足之處,取長(zhǎng)補(bǔ)短,去粗取精,從法律的角度出發(fā),秉持依法行事原則,密切結(jié)合我國(guó)的《刑法》和《體育法》,得出適合我國(guó)國(guó)情的相應(yīng)對(duì)策。通過這些對(duì)策研究,以期能減少和避免競(jìng)技體育操縱比賽犯罪行為,為我國(guó)競(jìng)技體育事業(yè)的健康有序發(fā)展貢獻(xiàn)一份力量。
[Abstract]:As a branch of sports field, competitive sports occupies an important position for a long time in the field of sports in China, and it is the type of sports that focuses on the cultivation and development of our country. At present, with the acceleration of the development of competitive sports in our country, as well as the change of commercialization and marketization of sports, competitive sports, driven by various interests, have produced some illegal behaviors. One of the most typical is the crime of rigging the game. From the angle of criminal law, combined with the relevant articles of the Sports Law of our country, this paper expounds three main forms of the crime of competition manipulation in competitive sports, including the unique crime pattern of our country "unit crime" as the main research object. It is necessary and urgent to punish this kind of crime by legal means through the description of its harmfulness and the judicial intervention. Our country should draw lessons from the experience of some developed countries in preventing and combating the rigging crime, mainly in the aspects of legislation and law enforcement, and sum up the problems and shortcomings in dealing with this kind of crime. From the point of view of law, according to the principle of acting according to law and combining the Criminal Law and Sports Law of our country closely, the corresponding countermeasures suitable for the national conditions of our country are obtained. Through the research of these countermeasures, we hope to reduce and avoid the criminal behavior of competitive sports manipulation, and contribute to the healthy and orderly development of competitive sports in China.
