【摘要】： 如何建立一套高效、透明、規(guī)范的國家公共人事管理制度,是當(dāng)代我國法治政府建設(shè)的重要課題。本文以公安文職制度為研究對象,立足于相關(guān)法學(xué)理論,運用歷史考察和比較分析相結(jié)合、價值分析與實證分析相結(jié)合的研究方法,對公安文職制度的現(xiàn)狀、合理性和合法性等問題進行了評析,并從法治政府的角度,探索公安文職制度法治化的解決途徑。 全文正文由五章構(gòu)成。第一章主要論述公安文職制度的概念、歷史發(fā)展和現(xiàn)實意義,闡明制度的基本內(nèi)容和存在價值;第二章主要從法學(xué)理論的角度,對公安文職制度的基本法律關(guān)系進行深入的解析,厘清制度本身所具有的行政法律關(guān)系與勞動法律關(guān)系“二元性”特征;第三章考察了英國、美國、法國以及我國香港地區(qū)警察機關(guān)的文職制度,分析、比較了上述國家和地區(qū)警察機關(guān)文職制度的發(fā)展背景和規(guī)范程度;第四章是通過對我國現(xiàn)有公安文職制度現(xiàn)狀的分析,指出我國公安文職制度建設(shè)過程中存在的規(guī)范性不足、法制保障缺失等問題;第五章則是立足于法治政府的角度,提出公安文職制度法治化的一些思路,包括與公務(wù)員法等相關(guān)法律的緊密銜接等。
[Abstract]:How to establish a set of efficient, transparent and standardized national public personnel management system is an important subject in the construction of our country's government ruled by law. This article takes the public security civilian system as the research object, bases on the related jurisprudence theory, uses the historical investigation and the comparative analysis, the value analysis and the demonstration analysis unifies the research method, the present situation of the public security civilian system. This paper analyzes the rationality and legitimacy, and explores the solution to the rule of law in the public security civilian system from the point of view of the government ruled by law. The text consists of five chapters. The first chapter mainly discusses the concept, historical development and practical significance of the public security civilian system, and clarifies the basic content and existence value of the system; The second chapter mainly from the legal theory angle, carries on the thorough analysis to the public security civilian system basic legal relations, clarifies the system itself has the administrative legal relation and the labor legal relation "duality" characteristic; The third chapter examines the civilian police system in Britain, the United States, France and Hong Kong, analyzes and compares the development background and normative degree of the civilian police system in the above countries and regions. The fourth chapter is through the analysis of the present situation of the public security civilian system in our country, points out the normative deficiency in the process of the construction of the public security civilian system in our country, the lack of the legal system guarantee and so on. The fifth chapter is based on the point of view of the government by law, put forward some ideas of the rule of law of the public security civilian system, including the civil service law and other related laws closely linked.
