【摘要】： 搶劫、搶奪、盜竊犯罪作為常見的幾種犯罪形態(tài),近年來持續(xù)高發(fā),嚴(yán)重危害人民財產(chǎn)與生命安全,成為困攏公安機(jī)關(guān)和政府部門多年的社會治安問題。2005年,公安部組織部署全國公安機(jī)關(guān)開展打擊“兩搶一盜”犯罪專項斗爭,針對當(dāng)前突出的“街面兩搶”、“飛車搶奪”、“盜搶汽車”、“入室盜竊”等案件開展專項治理,加大了打擊防控力度,通過治理行動,“兩搶一盜”犯罪突出的現(xiàn)象有所扭轉(zhuǎn),但破案率卻一直在低位徘徊,犯罪仍然高發(fā),“兩搶一盜”犯罪面臨隨時反彈上升的趨勢�！皟蓳屢槐I”犯罪原因涉及社會、文化、教育、立法、司法、公安機(jī)關(guān)打擊防范措施,社會治安綜合治理及政府有關(guān)部門等多方面因素,如何有效打擊現(xiàn)行犯罪,降低犯罪發(fā)案率,使犯罪分子受到應(yīng)有處罰,如何加強(qiáng)預(yù)防與控制,威懾危險分子,減少發(fā)案,如何從根本上遏制“兩搶一盜”犯罪,建立起打擊、預(yù)防、控制的長效機(jī)制,具有理論與實(shí)踐意義。筆者在有關(guān)專家學(xué)者對“兩搶一盜”犯罪的理論研究與實(shí)踐經(jīng)驗成果基礎(chǔ)上,比較借鑒國內(nèi)外有關(guān)文獻(xiàn),進(jìn)而明確了成文的目的與意義,提出了自己的觀點(diǎn),希望有所創(chuàng)新�！皟蓳屢槐I”犯罪是搶劫、搶奪與盜竊犯罪的合稱。主要特征表現(xiàn)在:人員構(gòu)成低齡化、低文化水平與外來化;組織形態(tài)呈團(tuán)伙化、職業(yè)化、智能化發(fā)展;侵害對象目標(biāo)明確,作案時間、地點(diǎn)有選擇性;行為特征具多樣化,預(yù)謀與快速性的特點(diǎn)。引起犯罪高發(fā)的原因及防控當(dāng)中的問題主要表現(xiàn)為:社會控制力弱化、貧富差距拉大、不良文化影響、犯罪相關(guān)人的因素,有關(guān)職能部門及公安機(jī)關(guān)措施不力,相關(guān)立法與制度因素等。防控對策方面提出了:公安機(jī)關(guān)加強(qiáng)職能、手段、體制與隊伍管理建設(shè);在犯罪化研究基礎(chǔ)上,完備相關(guān)立法與法律措施;動員、教育群眾,加強(qiáng)制度與理念建設(shè)等建議,完善相關(guān)保障,改進(jìn)社會預(yù)防與條件預(yù)防方面的措施等。希望能對現(xiàn)行“兩搶一盜”犯罪防控工作提供一定借鑒,是筆者完成本文的目的與意義
[Abstract]:The crime of robbery, robbery and theft, as several common forms of crime, has been persistently high in recent years, seriously endangering people's property and life safety, and has become a social security problem that has trapped public security organs and government departments for many years. In 2005, The Ministry of Public Security organized and deployed the national public security organs to launch a special struggle against the crime of "two robberies and one theft", and to deal with such cases as "two robberies on the streets", "seizing cars by flying", "stealing cars", "burglaries", and so on. Increased efforts to combat prevention and control, through control actions, "two robberies and one theft" crime prominent phenomenon has been reversed, but the rate of detection has been hovering in the low level, the crime is still high, "two robbery and one theft" crime is facing a trend of rising rebound at any time. The causes of the crime of "two robberies and one theft" involve social, cultural, educational, legislative, judicial, anti-preventive measures by public security organs, comprehensive management of public security and relevant government departments, and how to effectively crack down on existing crimes. How to reduce the rate of crime occurrence, so that criminals should be punished, how to strengthen prevention and control, how to deter dangerous elements, how to reduce the number of crimes committed, how to fundamentally curb the crime of "two robberies and one theft", and how to establish a long-term mechanism for cracking down, preventing and controlling crimes. It has theoretical and practical significance. On the basis of the theoretical research and practical experience of the crime of "two robberies and one theft", the author compares the relevant literature at home and abroad, then clarifies the purpose and significance of the writing, puts forward his own viewpoint and hopes to innovate. The crime of "two robberies and one theft" is a combination of robbery, robbery and theft. The main characteristics are as follows: low age, low level of education and extraneous personnel; organizational form is gang, professional and intelligent development; the target of aggression is clear, the time and place of crime is selective; Behavioral characteristics are diverse, premeditated and rapid. The causes of the high incidence of crime and the problems in prevention and control are mainly manifested in the weakening of social control, the widening gap between the rich and the poor, the negative cultural impact, the factors related to the crime, the lack of measures taken by the relevant functional departments and the public security organs. Related legislation and institutional factors. The countermeasures of prevention and control are as follows: strengthening the functions, means, system and team management of public security organs, perfecting relevant legislation and legal measures on the basis of criminalizing research; To mobilize, educate the masses, strengthen the construction of system and idea, perfect the relevant guarantee, and improve the measures of social prevention and condition prevention, etc. It is hoped that the purpose and significance of the author to complete this article can be used for reference in the current crime prevention and control work of "two robberies and one theft".
